The following locations are hereby designated for parking for
handicapped persons, and only such persons are permitted to park in
these designated areas using automobiles with special permits and
license plates for handicapped persons:
A. Scofield Street. Beginning at a point commencing 117 feet north-northwest
from the northwest corner of the intersection of Church and Scofield
Streets and running thence 40 feet in a north-northwest direction
along the easterly side of Scofield Street.
B. Orchard Street. Two parking spaces in the most northeasterly corner
of the Orchard Street parking lot bounded by Orchard Street on the
east and lands now owned by Joseph and Margaret Business (Tax Map
parcel 309-7-1917) on the north.
C. Thruway Market. Two parking spaces in the Thruway Market parking
lot which are located in an area the point of beginning being along
these courses and distances: Commencing at a point on the front face
of the Thruway Market, which point is west 169 feet from the southeast
corner of the building; thence southerly at a right angle to the building
a distance of 77 feet; thence west 22 feet parallel to the face of
the building; thence from this point of beginning 37 feet southerly
to a point which would be the southerly extension of the seventy-seven-foot
course; thence west and parallel to the twenty-two-foot course 11.5
feet; thence north 37 feet and parallel to the thirty-seven-foot course;
thence 11.5 feet along the twenty-two-foot course to the point of

D. Scofield Street. Beginning at a point 20 feet southeasterly from
the southwest corner of the intersection of Scofield Street and Orchard

A. Whenever any motor vehicle that does not have a parking permit for the handicapped in accordance with law is found parked in an area designated for handicapped parking, which areas shall specifically include the streets identified in §
291-18 as well as any other handicapped parking area required by the New York State Building Code, the Police Department of the Village of Walden shall have the power, right and authority to issue an appearance ticket returnable in the Village of Walden Justice Court for the violation of this section.
B. If there is no response in Justice Court to the appearance ticket
issued, the Court shall issue a summons to the owner of the motor
vehicle to which the appearance ticket was affixed and direct that
the same be served upon said owner. Any prosecution charging a violation
of this section, proof that the vehicle was parked in a violation
of this section, together with proof that the defendant named in the
summons issued by the Court was at the time of the violation the registered
owner thereof, shall constitute a presumption that the registered
owner of such vehicle was the person who parked or placed the vehicle
at the point where and at the time during which such violation occurred
or who gave his or her consent to the person who parked or placed
the vehicle at the point where and for the time during which such
violation occurred.
C. Every person convicted of a violation of any provision of this section
related to a violation of the handicapped parking prohibitions set
forth herein, shall for the first conviction thereof, be punished
by a fine of not more than $100 or by imprisonment of not more than
15 days or by both such fine and imprisonment; for a second such conviction
with 18 months thereafter, such person shall be punished by a fine
of not more than $200 or by imprisonment of not more than 45 days
or by both such fine and imprisonment; upon a third or subsequent
conviction within 18 months after the first conviction, such person
shall be punished by a fine of not more than $300 or by imprisonment
of not more than 90 days or by both such fine and imprisonment.
