This chapter shall be known as and may be cited as the "Spring
Garden Township Subdivision and Land Development Ordinance."
The purpose of these subdivision and land development regulations
is to provide for the harmonious development of the Township by:
A.Â
Assisting in the orderly and efficient integration of land developments
within the Township.
B.Â
Ensuring conformance of land development plans with the Comprehensive
Plan and public improvements plans.
C.Â
Ensuring the provision of adequate public facilities including roadways,
walkways, streetlighting, water supply, storm and sanitary sewerage
facilities, recreation sites, open spaces and other improvements for
the public health, safety and welfare.
D.Â
Ensuring coordination of intermunicipal public improvement plans
and programs.
E.Â
Securing the protection of water resources and drainageways and other
environmental resources.
F.Â
Requiring that each subdivision lot in flood-prone areas be provided
with a safe building site with adequate access and that public facilities
which serve such uses be designed and installed to preclude flood
damage at the time of initial construction.
G.Â
Protecting individuals from buying lands which are unsuitable for
use because of flood hazards by prohibiting the subdivision and/or
development of unprotected flood-prone lands.
H.Â
Facilitating the efficient movement of traffic.
I.Â
Securing equitable handling of all land development plans by providing
uniform standards and procedures.
J.Â
In general, promoting greater health, safety and welfare of the citizens
of the Township.
K.Â
Securing adequate sites for recreation, conservation, scenic and
other open-space purposes.
A.Â
No land development of any lot, tract or parcel of land shall be
made; no street, sanitary sewer, storm sewer, water main or other
improvements in connection therewith shall be laid out, constructed,
opened or dedicated for public use or travel, or for the common use
of occupants of buildings abutting thereon, except in accordance with
the provisions of this chapter.
B.Â
The authority for the control and regulation of subdivision and land
development within the Township shall be as follows:
(1)Â
Approval by the Township Board of Commissioners. The Spring Garden
Township Board of Commissioners, hereinafter referred to as the "Board
of Commissioners," shall be vested with the authority to approve or
disapprove all subdivision and land development plans.
(2)Â
Review by the Township Planning Commission. The Spring Garden Township
Planning Commission, hereinafter referred to as the "Planning Commission,"
shall be vested with the review of subdivision and land development
plans.
(3)Â
Review by the County Planning Commission. Plans for subdivision and
land development located within Spring Garden Township shall be forwarded
upon receipt by Spring Garden Township to the York County Planning
Commission for review and report. Spring Garden Township Board of
Commissioners shall not approve such plans until the County report
is received or until the expiration of 30 days from the date the application
was forwarded to the County.
