The Town Board of the Town of Hartland finds that the improper
construction of private driveways intersecting town highways may be
hazardous to the public and poses unnecessary expense to the town
and that installation of driveways according to specific standards
as monitored by the Highway Department will be in the best interests
of the health, safety and welfare of the citizens and property of
the town.
This chapter shall be entitled the "Driveway Installation Law
of the Town of Hartland."
This chapter shall apply to all that portion of the Town of
Hartland outside the Village of Middleport.
No driveway center line shall intersect a town highway less
than 50 feet from the intersection of any two highway right-of-way
lines and shall be constructed or renovated only after the issuance
of a permit by the Highway Superintendent of the town authorizing
such construction or renovation in accordance with the following conditions
and regulations:
A. Pipe must be sized by the Town Superintendent of Highways.
B. New corrugated metal pipe or highway grade approved plastic, provided
that not less than three feet of cover is used, are the only type
allowed.
C. Corrugated metal pipes are to be spliced and bolted with approved
corrugated metal pipe collars.
D. Pipe is to be placed in the center line of the ditch.
E. Any culvert pipe installed in the town right-of-way must be graded
to allow corrugations to have proper grade for flow through the pipe
and in no event shall said pipe or cover restrict highway drainage.
Sod and enough material must be removed from the ditch to allow corrugations
or bells to have proper grade. Unless otherwise determined by the
Superintendent, the town shall set the pipe.
F. No permanent concrete structures may be placed on the highway right-of-way,
such as headwalls, curbs, driveway markers or driveway aprons.
G. The driveway approach grade must be the same grade as the highway
shoulder so as not to allow drainage off the driveway onto the highway.
H. Any blacktop placed upon any town highway right-of-way or other town
property must be placed according to town specifications and will
be the responsibility of the property owner should any damage result.
I. Drainage pipe must have a drop inlet every 100 feet.
