It shall be unlawful for any person to keep,
or allow to be kept, any dog which, by causing frequent, long or excessive
noise, specifically but not necessarily limited to barking or howling,
shall disturb the comfort or repose of persons residing in the vicinity
of where the dog is kept.
The duty of administering and enforcing the
provisions of this article is hereby conferred upon the Animal Control
Officer or upon such other person as may be designated by the Board
of Supervisors, provided such designee may not hold any elective office
in the Township.
In determining whether said noise, barking or
howling shall be frequent, long, or excessive so as to disturb the
comfort or repose of the persons residing in the vicinity where the
animal is kept, the Animal Control Officer or Board designee may take
into account the totality of the circumstances, including but not
limited to the zoning area in which the alleged violation has occurred.
Any person who shall violate the provisions of this article shall, upon being found liable therefor in a civil enforcement proceeding, be punishable as provided in §
1-3, Civil enforcement, of the Code of the Township of South Strabane.

This article shall not apply to the following:
A. Institutions accredited as zoos or aquariums.
B. Licensed humane societies.
C. Animal Control Officers, provided that such activity
is in furtherance of the officer's duties.
D. Licensed veterinary hospitals or clinics.
E. Licensed commercial pet stores, provided such stores
maintain appropriate licenses or other permits as may be required
by state or federal agencies.
F. Any other entity as permitted by Township ordinances.
No animal located within the Township prior
to the enactment of this article shall be exempt from the provisions
of this article.
