A. 
Purpose. This chapter provides for the administration and enforcement of the New York State Uniform Fire Prevention and Building Code (the Uniform Code) and the State Energy Conservation Construction Code (the Energy Code) in the City of Geneva, New York.
B. 
Municipal Home Rule Law. This chapter is adopted pursuant to § 10 of the Municipal Home Rule Law.
C. 
Applicability. Except as otherwise provided in the Uniform Code, other state law, or other section of this chapter, all buildings, structures, and premises, regardless of use or occupancy, are subject to the provisions of this chapter.
If a section, subsection, sentence, clause or phrase of this code is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this code.
A. 
Scope. Unless otherwise expressly stated, the following terms shall, for the purposes of this code, have the meanings shown in this chapter.
B. 
Interchangeability. Words stated in the present tense include the future; words stated in the masculine gender include the feminine and neuter; the singular number includes the plural and the plural the singular.
C. 
Terms defined in other codes. Where terms are not defined in this chapter and are defined in the Uniform Code and the Energy Code, such terms shall have the meanings ascribed to them as in those codes.
D. 
Terms not defined. Where terms are not defined through the methods authorized by this section, such terms shall have ordinarily accepted meanings such as the context implies.
E. 
Parts. Whenever the words "dwelling unit," "dwelling," "premises," "building," "rooming house," "rooming unit," "housekeeping unit" or "story" are stated in this code, they shall be construed as though they were followed by the words "or any part thereof."
F. 
As used in this chapter, the following terms shall have the meanings indicated:
BUILDING PERMIT
A building permit issued pursuant to § 230-4 of this chapter. This term shall also include any building permit which is renewed, amended or extended pursuant to any provision of this chapter.
CERTIFICATE OF OCCUPANCY
A certificate issued pursuant to § 230-7 of this chapter.
CITY
The City of Geneva, New York.
CODE ENFORCEMENT OFFICER
The Code Enforcement Officer appointed pursuant to § 230-12 of this chapter.
CODE ENFORCEMENT PERSONNEL
Shall include the Code Enforcement Officer and all inspectors.
COMPLIANCE ORDER
An order issued by the Code Enforcement Officer pursuant to § 230-19 of this chapter.
DWELLING
A building that contains dwelling units used, intended or designed to be used, rented, leased, let or hired out to be occupied for living purposes.
DWELLING UNIT
A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation.
EMERGENCY
Any event that is an immediate threat to health, life, property and/or safety.
ENERGY CODE
The State Energy Conservation Construction Code, as currently in effect and as hereafter amended from time to time.
INSPECTOR
An inspector appointed pursuant to § 230-12 of this chapter.
MULTIPLE DWELLING
This term is defined by the New York State Multiple Residence Law that is currently in effect and as hereafter amended from time to time.
OPERATING PERMIT
A permit issued pursuant to section § 230-6 of this chapter. This term shall also include any operating permit which is renewed, amended or extended pursuant to any provision of this chapter.
OWNER
Any person, agent, operator, firm or corporation having a legal or equitable interest in the property as recorded in the official records of Ontario County, New York, as holding title to the property.
PERMIT HOLDER
The person to whom a permit has been issued.
PERSON
An individual, corporation, partnership or any other group acting as a unit.
RENTAL DWELLING UNIT
Any dwelling unit that is occupied by one or more persons, none of whom is the owner.
SHALL
The term is construed as mandatory.
STOP-WORK ORDER
An order issued pursuant to § 230-16 of this chapter.
TEMPORARY CERTIFICATE
A certificate issued pursuant to § 230-7 of this chapter.
UNIFORM CODE
The New York State Uniform Fire Prevention and Building Code, as currently in effect and as hereafter amended from time to time.
