Purpose. This chapter provides for the administration and enforcement
of the New York State Uniform Fire Prevention and Building Code (the
Uniform Code) and the State Energy Conservation Construction Code
(the Energy Code) in the City of Geneva, New York.
Applicability. Except as otherwise provided in the Uniform Code,
other state law, or other section of this chapter, all buildings,
structures, and premises, regardless of use or occupancy, are subject
to the provisions of this chapter.
If a section, subsection, sentence, clause or phrase of this
code is, for any reason, held to be unconstitutional, such decision
shall not affect the validity of the remaining portions of this code.
Interchangeability. Words stated in the present tense include the
future; words stated in the masculine gender include the feminine
and neuter; the singular number includes the plural and the plural
the singular.
Terms defined in other codes. Where terms are not defined in this
chapter and are defined in the Uniform Code and the Energy Code, such
terms shall have the meanings ascribed to them as in those codes.
Terms not defined. Where terms are not defined through the methods
authorized by this section, such terms shall have ordinarily accepted
meanings such as the context implies.
Parts. Whenever the words "dwelling unit," "dwelling," "premises,"
"building," "rooming house," "rooming unit," "housekeeping unit" or
"story" are stated in this code, they shall be construed as though
they were followed by the words "or any part thereof."
A building permit issued pursuant to § 230-4 of this chapter. This term shall also include any building permit which is renewed, amended or extended pursuant to any provision of this chapter.
A single unit providing complete, independent living facilities
for one or more persons, including permanent provisions for living,
sleeping, eating, cooking and sanitation.
A permit issued pursuant to section § 230-6 of this chapter. This term shall also include any operating permit which is renewed, amended or extended pursuant to any provision of this chapter.
Any person, agent, operator, firm or corporation having a
legal or equitable interest in the property as recorded in the official
records of Ontario County, New York, as holding title to the property.
