No person shall be appointed to serve on the Board of Water Commissioners of the Village of Nyack unless, at the time of the appointment, said person is a resident of the Village of Nyack, or a resident within the service area of the Nyack Water Department who is served by Nyack Water Department.
Should a person duly appointed to the Board of Water Commissioners discontinue his residence within the Village of Nyack or within the service area of the Nyack Water Department, notwithstanding the provisions of the Village Law of the State of New York to the contrary, the Board of Trustees of the Village of Nyack shall have the authority to waive the residency requirement for such person for the rest of that person's appointed term or any part thereof, provided that the new residence of said Commissioner is within one mile of the boundary of the Village of Nyack or of the service area of the Nyack Water Department.
Any such person for whom the Village Board waives the residency requirement shall not be eligible to be reappointed for an additional term as Water Commissioner, unless and until such person reestablishes residency within the Village of Nyack or within the service area of the Nyack Water Department.
The power granted to the Board of Trustees of the Village of Nyack by this article shall be limited to the extent that at no time shall a majority of the Board of Water Commissioners be nonresidents of the Village of Nyack.
This article shall be renewed each year by the Board of Trustees of the Village of Nyack at its annual organization meeting in January.
If any provision of this article, or the application thereof to any person or circumstance, is held invalid, the remainder of this article, and the application of such provision to other persons or circumstances, shall not be affected thereby.
This article shall take effect immediately upon filing with the Secretary of State.
