As used in this article, the following terms shall have the
meanings indicated:
INSTRUMENTALITY OF AN OFFENSE
A vehicle, the use of which contributed directly and materially
to the commission of an offense as defined in this article.
OFFENSE
The aggravated unlicensed operation of a motor vehicle in
the third degree pursuant to § 511(1) of the New York Vehicle
and Traffic Law, when a suspension or revocation occurs due to a violation
of § 510(2)(a)(i), (ii), (iii), (iv) or (vi), 510(2)(b)(i)
or (xii), or 510(3)(e) of the New York Vehicle and Traffic Law; or
a violation of § 509(1) of the New York Vehicle and Traffic
Law if the operator has at least once before been convicted of § 509(1)
of the New York Vehicle and Traffic Law.
SEIZING AGENCY
The law enforcement agency seizing the instrumentality of
an offense.
The County Attorney shall issue and promulgate such rules and
regulations as may be necessary to implement the provisions of this
article.
This article shall apply to offenses occurring on or after the
effective date of this article.
