[Amended 11-14-1988 by L.L. No. 3-1988]
The boundaries and divisions of the above-mentioned districts are hereby established as shown on the map entitled "Zoning Map of the Village of Malone, New York," as amended, a certified copy of which shall be on file in the office of the Village Clerk. Said map and all explanatory matter thereon accompanies and is hereby made a part of this ordinance. Notwithstanding the foregoing, and despite the boundaries and divisions specified on said map, the following area shall be zoned R-LB, Residence-Limited Business District: bounded north by the south side of Huntington Street; bounded east by the west side of Railroad Street; bounded south by the north line of Clark Street; and bounded west by the easterly line of Fort Covington Street.
Where uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the Zoning Map, the following rules shall apply:
A.
Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be such boundaries.
B.
When district boundaries are so indicated that they are approximately parallel to the center lines or right-of-way lines of streets or highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the Zoning Map. If no distance is given, such dimension shall be determined by the use of the scale shown on said Zoning Map.
C.
Where the boundary of a district follows a railroad line, such boundary shall be deemed to be located midway between the main tracks of said railroad line.
D.
Where the boundary of a district follows a stream, lake or other body of water, said boundary line shall be deemed to be at the center of the body of water and any island therein shall belong to the district in which it is chiefly situated.
E.
In case of uncertainty as to the true location of a district boundary line in a particular instance, the Board of Appeals shall render a determination with respect thereto.
