It shall be unlawful for any person to make, continue or cause
to be made or continued any unnecessary noise which either annoys,
injures or endangers the comfort, repose, health or safety of any
one or more persons, whether it be by loud and abusive language or
by the operation of any machine or motor vehicle or vehicle or exercise
of any trade, calling or otherwise type of noise, unless the making
and continuing of the same is necessary for the protection or preservation
of property or of the health, safety, life or limb of some person.
As used in this chapter, the following terms shall have the
meanings indicated:
Persons, corporations, companies, associations, joint-stock
associations, partnerships, copartnerships, estates or any other entity
and persons, their assignees, lessees, trustees or receivers appointed by any court whatsoever or by any other means, except the
state, municipality and public districts.
A.
Any vehicle, GoKart, minibike, lawn mower, chain saw or any other
motor-driven machine that may create unnecessary noise may not be
operated beyond an unusual hour at night (10:00 p.m. to 8:00 a.m.)
or before 10:00 a.m. on Sunday.
B.
No person shall maintain any vehicle that does not have a muffling
device which prevents any unusual or loud noise or creates excessive
noise by inadequate mufflers, and no person shall operate such motor
vehicle in any manner that shall create excessive or unusual noise
by squealing or spinning tires or racing engines at abnormal speed
or by blowing horns or warning devices when not necessary or when
no emergency is in effect.
Any person who violates any rule or regulation of any section
of this chapter shall be subject to a penalty for the violation of
any such rule or regulation not exceeding $250 or 30 days' imprisonment,
except where penalties established by statute apply.
