Every person convicted of a traffic infraction for a violation
of any provision of this chapter which is not a violation of any provision
of the Vehicle and Traffic Law of the State of New York shall, for
a first conviction thereof, be punished by a fine of not more than
$50 or by imprisonment for not more than 15 days, or by both such
fine and imprisonment; for a second such conviction within 18 months
thereafter, such person shall be punished by a fine of not more than
$100 or by imprisonment for not more than 45 days, or by both such
fine and imprisonment; upon a third or subsequent conviction within
18 months after the first conviction, such person shall be punished
by a fine of not more than $250 or by imprisonment for not more than
90 days, or by both such fine and imprisonment.
Any persons who shall violate or fail to comply with any of the provisions of Article
IV of this chapter or who shall counsel, aid or abet any such violation or failure to comply shall be deemed guilty of disorderly conduct and shall be punishable by a fine not to exceed $250 or by imprisonment not to exceed 15 days, either or both penalties to be imposed at the discretion of the court; provided, however, that should the violation consist solely of parking or standing a vehicle beyond the lawful time as provided in § 278-38 hereof, upon due notification of such violation to the operator or owner of such vehicle, the prescribed parking fines, if paid within the specified time limit to the Clerk of the Traffic Violations Bureau of the Village of East Rockaway, with a plea of guilty, shall be considered settlement in full of any and all penalties hereunder. Failure to pay as provided or to appear voluntarily in court will subject the operator or owner of such vehicle to a warrant for arrest and the impositions of such penalties as the law may provide.
