The following regulations shall apply to all existing buildings
which are located within the service area of the new sewer and/or
water lines within the Town.
As soon as the sewer main is ready for operation, the Town shall
give all property owners with an existing building, residential or
commercial, within 200 feet of the sewer main notice to connect all
sewer-related plumbing fixtures to the sewer main. All property owners
with an existing building, residential or commercial, within 200 feet
of the sewer main shall have 180 days to comply with said notice.
In the event that a property owner with an existing building, residential
or commercial, fails to comply within 180 days, the Town shall be
permitted to enter the premises to have the work done at the property
owner's expense; which cost shall constitute a lien on the property.
In addition, the property owner shall be subject to a fine of $5 per
day for each day beyond the one-hundred-and-eighty-day term for which
the connection has not been made. The property owner shall also be
subject to the payment of the regular user charge as outlined in Sections
4-01 through 4-04 of the Sewer Policy Manual, whether connected or
not connected to the sewer main.
Upon the property owner's connection to the sewer main, he shall
abandon, close, fill and leave in a sanitary condition all septic
tanks so that no odor or nuisance shall arise therefrom. In the event
that the property owner fails to comply with this section, the Town
shall have the right to enter the premises and cause the required
work to be done at the property owner's expense, which cost shall
constitute a lien on the property.
As soon as the water main is ready for operation, the Town shall
give all property owners with an existing building, residential or
commercial, within 200 feet of the main notice to connect all water
plumbing fixtures to the water main. All property owners with an existing
building, residential or commercial, within 200 feet of the water
main shall have 180 days to comply with said notice. In the event
that a property owner with an existing building, residential or commercial,
fails to comply within 180 days, the Town shall be permitted to enter
the premises and have the work done at the property owner's expense,
which cost shall constitute a lien on the property. In addition, the
property owner shall be subject to a fine of $5 per day for each day
beyond the one-hundred-and-eighty-day term for which he is not connected
to the new water line.
