There shall be established in the Town of Newtown (the "Town") a public Water and Sewer Authority, with the authority to plan and direct the development, acquisition, financing, construction, operation and maintenance of such water supply and distribution systems and sewerage systems as may be required to properly serve the needs of the Town.
The Water Pollution Control Authority shall be redesignated as the Water and Sewer Authority for the Town and shall have all of the powers with regard to sewers of such an authority pursuant to Chapter 103 of the Connecticut General Statutes.
The Water and Sewer Authority shall exercise all powers of the Town with respect to water pursuant to Chapter 102 of the Connecticut General Statutes except those powers with respect to bonding and use rate setting which are specifically reserved to the legislative body. With respect to water bonding and water use rates, the Water and Sewer Authority shall make recommendations for such bonding or the setting of such rates to the legislative body.
Membership shall be as follows:
A. 
The Water and Sewer Authority shall be composed of seven resident electors of the Town. The Board of Selectmen shall appoint all members to said Authority, except that two of the appointments shall be made on the recommendation of the Board of Burgesses of the Borough of Newtown. At all times the Borough shall be represented by two members recommended by the Burgesses. The membership shall be in accordance with Chapter 4 of the Town Charter.
B. 
All appointments shall be for four years. Upon the expiration of the term of any member of the Authority, or in the event a vacancy exists on said Authority, the Board of Selectmen shall appoint a new member to fill the vacancy. Notwithstanding the above, all prior appointments to the Water Pollution Control Authority shall continue as appointments to the Water and Sewer Authority as though the Water Pollution Control Authority had continued to exist.
A. 
A separate account shall be kept by the Water and Sewer Authority for all funds derived from the sewerage system, which account shall in all respects comply with the requirements of Section 7-268 of the Connecticut General Statutes.
B. 
A separate account shall be kept by the Water and Sewer Authority for all funds derived from the water system which account shall in all respects comply with the requirements of Section 7-240 of the Connecticut General Statutes.
The Water and Sewer Authority shall cooperate with and obtain available assistance from federal, state, regional, and local agencies concerned with public water and sewerage systems.
The Water and Sewer Authority shall establish separate regulations relative to the operation of and connection to the water and sewerage systems.
