This article is enacted under the authority granted by N.J.S.A. 33:1-1 et seq., An Act Concerning Alcoholic Beverages, being Chapter 436, P.L. 1933, as supplemented and amended, and in accordance with the rules and regulations promulgated by the Director of the Division of Alcoholic Beverage Control of the State of New Jersey and other applicable laws of the State of New Jersey.
For the purpose of this article, words and phrases herein shall have the same meanings as they have in N.J.S.A. 33:1-1 et seq., and the rules and regulations of the Director of the Division of Alcoholic Beverage Control, as supplemented and amended.
The Township Committee of the Township of Alexandria, being the governing body of said municipality, shall constitute the authority for the issuance of licenses and to otherwise administer the provisions of this article.
It shall be unlawful to sell or distribute alcoholic beverages in the Township of Alexandria without a valid license currently in effect, or contrary to the provisions of this article or applicable state laws and regulations.
A. 
There shall be three classes of licenses issued in the Township of Alexandria, as follows:
(1) 
Plenary retail consumption.
(2) 
Plenary retail distribution.
(3) 
Club.
B. 
Annual fees for plenary retail consumption licenses shall be $2,000.

C. 
The annual fee for a plenary retail distribution license shall be $2,000.
D. 
The annual fee for a club license shall be $50.
A. 
Retail consumption sales hours.

(1) 
No alcoholic beverage shall be sold, served, delivered or consumed on any licensed premises between the hours of 2:00 a.m. and 10:30 a.m. on Sunday and between the hours of 2:00 a.m. and 7:00 a.m. on other days, except as follows:
(a) 
On December 24, licensed premises may remain open and sell or offer to sell alcoholic beverages until the hour of 5:00 a.m. on December 25, the succeeding day.
(b) 
On December 31, licensed premises may remain open and sell or offer to sell alcoholic beverages until the hour of 5:00 a.m. on January 1, the succeeding day.
(2) 
At no other time and upon no other occasion may licensed premises remain open during the closing hours specified in Subsection A(1) of this section.
B. 
Retail package sales hours. The sale of alcoholic beverages in original containers by plenary retail distribution licensees for consumption off the licensed premises shall be permitted between the hours of 12:00 noon and 10:00 p.m. on Sunday and between the hours of 9:00 a.m. and 10:00 p.m. on any other day of the week. In addition, the sale of wine and malt alcoholic beverages in original bottle or can containers for consumption off the premises shall be permitted during the hours authorized by state law and regulations.
C. 
Club license hours. No club licensee shall sell, serve or deliver, or allow, permit or suffer the sale, service, delivery or consumption of any alcoholic beverage on the licensed premises during the hours or on days when plenary retail consumption licensees in the Township of Alexandria are prohibited from such activity by this article.

A violation of this article shall be punishable as provided in Chapter 1, General Provisions, Article I. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.

It shall be unlawful for any person under the legal age who, without legal authority as hereinafter defined, knowingly possesses or knowingly consumes an alcoholic beverage on private property.
A person under the legal age shall be deemed to possess or consume an alcoholic beverage without legal authority if said possession or consumption is not in connection with any of the following:
A. 
In connection with a religious observance, ceremony or rite; or
B. 
In the presence of and with the permission of a parent, guardian or relative who has attained the legal age to purchase and consume alcoholic beverages; or
C. 
By any such person while actually engaged in the performance of employment by a person licensed under Title 33 (the Alcoholic Beverage Control Law) or while actively engaged in the preparation of food while enrolled in a culinary arts or hotel management program at a county vocational or post secondary educational institution.
As used in § 55-9 of this article, the following terms shall have the meanings indicated:
GUARDIAN
A person who has qualified as a guardian of the underage person pursuant to testamentary or court appointment.
RELATIVE
The underage person's grandparent, aunt, uncle, sibling or any other person related by blood or affinity.
A violation of this article shall be punishable by a fine of $250 for the first offense, and $350 for any subsequent offense. In addition to any fine imposed, the court may suspend or postpone for six months the driving privilege of the defendant in accordance with the procedures set forth in N.J.S.A. 40:48-1, as amended.
