Editor's Note: The introduction of this ordinance read as follows: "WHEREAS, the Cooperative was formed in accordance with the authorization contained in the Act of July 12, 1972 (P.L. 762, No. 180, as amended, 53 P.S. § 481 et seq.) known as the Intergovernmental Cooperation Act, initially by East Hempfield Township, East Lampeter Township, Manor Township and the Borough of Ephrata, all of which entities are municipalities located within the County of Lancaster, Commonwealth of Pennsylvania; and WHEREAS, the Intergovernmental Cooperation Act (53 P.S. § 12720.101 et seq.) provides that any joint cooperation agreement shall be deemed in force as to any municipality when the same has been adopted by ordinance by all cooperating municipalities."
West Manchester Township shall join with other municipalities in accordance with the Pennsylvania Intergovernmental Cooperation Act[1] by becoming a member of the cooperative and entering into the intergovernmental cooperation agreement for intergovernmental insurance cooperative contract, as amended, which is adopted by reference with the same effect as if it has been fully set out verbatim in this section, and a copy of which shall be filed with the minutes of the meeting at which this article was enacted.

West Manchester Township is authorized to enter into the intergovernmental agreement for the purposes contained therein. These actions are to be taken by the officials, employees or appointees of West Manchester Township designated for this purpose, pursuant to general or specific instructions by the Board of Supervisors of West Manchester Township.
The cooperative is designated as having official custody of such of the funds of this Township as are budgeted by the cooperative pursuant to the terms of the intergovernmental agreement.
As required by the Intergovernmental Cooperation Act, the following matters are specifically found and determined:
A. 
The conditions of the agreement are set forth in the intergovernmental cooperation agreement for intergovernmental insurance cooperative referred to in § 7-2 herein.
B. 
The participation of West Manchester Township in the cooperative shall be for a period of not less than three years.
C. 
The purpose and objectives of the agreement are to enter into an intergovernmental contract to form a local government insurance cooperative to select and contract with a common insurance carrier for employee benefits, which may include but are not necessarily limited to insurance covering life, health, hospitalization, accident, medical and surgical services, and to defend and protect, in accordance with the agreement, the liability of the Board of Directors, officers and employees of the cooperative, and to delegate the administration of the cooperative to a Board of Directors appointed and/or elected pursuant to the agreement.
D. 
The cooperative shall be managed by a Board of Directors pursuant to the terms of the agreement.
E. 
All property, real or personal, shall be acquired, managed or disposed of by the cooperative in accordance with the terms of the agreement.
