No fire company or other person shall interfere with or participate
in any way in fire-fighting activities or respond to an alarm of fire
within the confines of West Manchester Township unless such person
or fire company is granted authority by the Board of Supervisors to
provide fire protection to the inhabitants of West Manchester Township
or is a fire company requested to assist a fire company granted such
authority by the Board or unless such person is a police officer.
On and after the effective date of this chapter, the Board of
Supervisors authorizes and directs Lincolnway Fire Company No. 1 of
West Manchester Township and the Shiloh Fire Company to provide fire
protection within the confines of West Manchester Township.
The Board of Supervisors shall assign a territorial district
to Lincolnway and Shiloh and each fire company shall provide primary
fire protection within its territorial district No other fire company
or person shall provide fire protection or fight fires within the
territorial districts assigned to Lincolnway and Shiloh unless requested
to do so by the Board of Supervisors or the Fire Chief of Lincolnway
or Shiloh.
The authority of Bair to fight fires or to provide fire protection
within the confines of West Manchester Township is revoked upon the
effective date of this chapter.
The Board of Supervisors may, out of the General Township Fund,
appropriate moneys to any fire company authorized to provide fire
protection within the confines of West Manchester Township for the
purchase and maintenance of fire apparatus, for the operation and
maintenance of the fire company and for the construction, repair and
maintenance of fire company houses. An annual report of the expenditure
of such appropriated funds shall be made to the Board for each completed
fiscal year of the Township by each fire company receiving an appropriation
from the Township. The report shall be filed on forms supplied by
the Township, shall be verified by an officer of the fire company
submitting the report and shall be filed with the Township before
any further payments shall be made to the fire company out of appropriations
for any current fiscal year.
The Township is authorized to adopt, by resolution of the Board
of Supervisors, such rules and regulations as it deems necessary to
carry out the intent of this chapter and to govern fire companies
and their officers.

Any person who shall violate any of the provisions of this chapter
shall, upon being found liable therefor in a civil enforcement proceeding
commenced by West Manchester Township, pay a fine not exceeding $600
plus all court costs, including reasonable attorney's fees, incurred
by West Manchester Township. West Manchester Township police officers,
the appropriate code enforcement officers of West Manchester Township
or other appropriate officer or officers of West Manchester Township
shall have the power to enforce the provisions of this chapter. The
amount of the fine imposed for the violation of this chapter shall
be established by the officer who determines that a violation has
occurred. Notice of the violation of this chapter and the amount of
the fine imposed shall be given by personal delivery or by certified
mail to the person violating this chapter. If the person violating
this chapter fails or refuses to pay the fine imposed within the period
specified in the notice of the violation of this chapter, the Township
shall file a civil enforcement proceeding with the District Magistrate
to enforce the fine imposed.
In the case of continued violation of the provisions of this
chapter, the Board may, in addition to other remedies, institute in
the name of the Township any appropriate action or proceeding to prevent,
restrain, enjoin, correct or abate continued violations of the provisions
of this chapter.
