As used in this article, the following words, terms and phrases shall have the following meanings, unless it is apparent from the context that a different meaning is intended:
BOROUGH
The Borough of Mount Joy, Lancaster County, Pennsylvania.
FIRE CHIEF
The Fire Chief of the fire company responsible for the fire protection of the Borough.
FIRE COMPANY
Fire Department Mount Joy, Inc., the fire company responsible for providing first due response fire-protection services within the Borough, as officially recognized by ordinance of the Borough.
FIRE-FIGHTING ACTIVITIES
Includes, but shall not be limited to, responding to an alarm or other notification of a fire or other emergency situation, acting to extinguish a fire, providing assistance to persons involved in a fire or other emergency situation and responding to hazardous material emergencies; provided, however, that response to medical emergencies by physicians, emergency medical technicians or other persons with medical training shall not be considered fire-fighting activities.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind and the officers of such corporation and the members of such partnership or association.
POLICE CHIEF
The Chief of Police of the Police Department or his designated representatives.
POLICE or POLICE DEPARTMENT
The Police Department of the Borough.

The Borough Council, by ordinance, has recognized the Fire Company as the fire company to provide first due response fire-fighting activities in the Borough. No other organization, association or volunteer fire company is authorized to provide first due response fire-fighting activities within the Borough. No other organization, association or volunteer fire company is authorized to provide second, third or fourth due response fire-fighting activities, unless such organization, association or volunteer fire company is responding to a specific request from Lancaster County Communications, the Fire Company or the Police Department to provide assistance to the Fire Company.
It shall be unlawful for any person to engage in fire-fighting activities within the limits of the Borough, unless:
A. 
Such person is the Fire Company or is a member of the Fire Company.
B. 
Such person is a member of the Police Department.
C. 
Such person is a volunteer fire company which is providing second, third or fourth due response service after notification from Lancaster County Communications, or such person is a member of such a volunteer fire company.
D. 
Such person has been requested to provide such fire-fighting activities by the Fire Chief, the Police Chief or a member of the Police Department.
E. 
Such person is fighting a fire upon his own premises or upon premises upon which he was present at the time the fire was discovered.
Any person violating any of the provisions of this article shall, upon conviction in a summary proceeding, be sentenced to pay a fine to the Borough of not less than $100 nor more than $600 for each offense and costs of prosecution and, in default of payment, to undergo imprisonment not exceeding 30 days.
