As used in this article, the following terms shall have the
meanings indicated:
PERMIT
A permit issued by West Manchester Township authorizing a
number of movements across a Township road or highway at specified
locations within a fixed period of time of a vehicle used to cross
a highway to get from one commercial industrial facility to another
commercial industrial facility under the same operation.
PERMITTEE
The person to whom a permit is issued.
PERSON
A natural person, firm, copartnership, association or corporation.
TOWNSHIP
The Township of West Manchester.
VEHICLE
Every device in, upon or by which any person or property
is or may be transported or drawn upon a highway, except devices used
exclusively upon rails or tracks.
Upon proper application to the Township, the Township is authorized to issue a permit as defined in §
139-33 of this article.
An application for a permit shall contain the following:
A. The name and address of the proposed permittee.
B. The type of vehicle for which a permit is requested.
C. The identification number of the vehicle for which a permit is requested.
D. The location where the vehicle will cross the Township road or highway.
A permit issued pursuant to this article shall expire on the
31st day of December of the calendar year for which the permit was
issued.
At the time the application for a permit is filed, the permittee
shall pay a fee of $25 to the Township.
A permit issued pursuant to this article shall only be valid
for the vehicle identified in the application and shall not be transferable
to any other vehicle.
The Township may condition permits issued pursuant to this article
by limiting the number of trips or by establishing seasonal or other
time limitations or geographic locations including limitations as
to prescribed highway or roads under the jurisdiction of the Township
or by otherwise limiting or prescribing conditions of operation under
the permit as the Township shall deem necessary to protect the safety
of highway or road users, to promote efficient movement of traffic
or to protect the highways or roads. The Township may require such
undertaking or security as it deems necessary to compensate for any
damage to any highway or road or structure or appurtenance.
Every permit issued pursuant to this article shall be carried
in the vehicle and shall be open to inspection by any police officer
or authorized agent of the Township or any person having an accident
involving a permitted vehicle.
A permit shall be revocable for cause.
The permittee shall be liable for all damage to any highway,
road, structure or appurtenance sustained as a result of operating
or moving under the permit.
Whenever a permit is issued pursuant to this article for crossing
a highway or road, it shall be unlawful to move a vehicle along the
highway or road.

Any person violating the provisions of this article shall, upon
conviction thereof before a District Justice having jurisdiction,
be sentenced to pay a fine of not more than $300 and the costs of
prosecution and in default of the payment of such fine and costs,
to undergo imprisonment in the county jail for a period of not more
than 30 days, or both.
