No person shall install or attempt to install any chimney, stove
pipe or solid-fuel-burning stove or appliance, nor construct or install
any chimney or stove pipe unless such installation is in accordance
with the rules and regulations established by this chapter and pursuant
to a valid building permit.
Application for a permit to install a chimney, stove pipe or
solid-fuel-burning stove or appliance shall be made to the building
official on a form provided by the Borough, which shall include drawings
and specifications setting forth exactly how the installation is to
be made and setting forth the materials to be used and such other
information as is requested. The application shall be accompanied
by a permit fee, which shall be established by the Council of New
Britain Borough.
The building official shall issue a permit for such installation
when he has satisfied himself by a review of the application, drawings
and specifications and by an inspection of the premises where the
proposed installation is to occur that the installation can be made
in accordance with the requirements of this chapter. The applicant
shall notify the building official when the installation is completed
so that the final inspection and certification can be made by the
building official that the installation has been made in accordance
with the terms of this chapter. No placing of the installation into
operation shall occur until final inspection is approved by the building
official.
The Borough of New Britain adopts rules and regulations in pamphlet
form, regulating the installation and construction of solid-fuel-burning
stoves and appliances and the construction of chimneys and the installation
of the same, all of which is made a part hereof by reference. The
pamphlet shall be available at the Borough Hall and shall be delivered
to the applicant at the time of the payment of the permit fees.
Any person, firm or corporation violating any provision of this
chapter shall, upon conviction thereof, be sentenced to pay a fine
of not more than $600 and costs of prosecution, and, in default of
payment of such fine and costs, to imprisonment for not more than
30 days.
