As used in this article, the following words and phrases shall have the meanings given to them in this section:
AIR RIFLE
Any air gun, air pistol, spring gun, spring pistol, or BB gun, which impels a pellet of any kind with a force that can reasonably be expected to cause bodily harm.
PAINTBALL GUN OR RIFLE
A device designed and manufactured to propel, by gas or air, an encapsulated gelatin paintball or other projectile containing paint, ink or a similar material.
It shall be unlawful for any person to discharge any air rifle or paintball gun or paintball rifle or fire or shoot any bow and arrow, compound bow or otherwise, or crossbow, within the limits of the Borough of New Britain, except that a person may discharge such a device on his or her own premises inside a fully enclosed (four solid walls and a ceiling) range adapted to that purpose. No minor shall possess or use such a device in the absence of adult supervision.
Any person violating this article shall be subject to conviction by a District Justice of a summary offense punishable by a fine of up to $500 or, for a subsequent offense, a fine of up to $1,000, and in default of payment therefor (fine for first or subsequent offense), suffer imprisonment for a period not to exceed 30 days.
No portion of this article shall be construed to be more restrictive any of the provisions of the Uniform Firearms Act[1] or with any provision of Title 34 of the Pennsylvania Statutes regulating hunting. Wherever any such conflict may be found to exist, the provisions of the Uniform Firearms Act or Title 34 shall prevail. It is however, the intention of Borough Council that the provisions herein regulating air rifles and paintball guns or rifles are intended to be more restrictive than provided in state law as permitted at 18 Pa.C.S.A. § 6304(e).
