The purpose of this chapter is to allow postal services, emergency services and others seeking Borough residents to more easily identify the location of the addressed property and/or its occupants.
As used in this chapter, the following terms shall have the meanings indicated:
BUILDINGS/STRUCTURE
Any building/structure currently or intended to be occupied as either a residence, business or industry.
NUMERIC or ALPHANUMERIC
Any combination of numbers 0 through 9 and letters A through Z.
PROPERTY OWNER/OCCUPANT
The owner, or if a leased property, the occupant of any subject property required to have identifying numeric or alphanumeric markings placed upon it.
All properties owners/occupants required to place numeric or alphanumeric markings on any property as required herein shall place this markings in a location which would be viewable and observing from the street fronting the subject property. The size of these markings shall be sufficient in size to allow persons to determine the numeric address of the property while viewing it from the street parallel to the property. These markings shall be placed either on a mailbox or within two feet of the entrance to the building which they intend to identify.
In the event a property owner/occupant fails to affix the requisite markings as required herein, the following procedures shall take place:
A. 
The police shall send a letter to the property owner/occupant of their noncompliance with this chapter, and their obligation to comply with this letter shall include a notice that the property owner/occupant has 10 days to come into compliance with this chapter;
B. 
In the event the property owner complies with this notice and chapter, no further action will occur;
C. 
In the event the property owner/occupant fails to comply within the ten-day period provided herein, a citation shall be issued for violation of this chapter;
D. 
Any property owner/occupant found to be in violation of any provisions of this chapter shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Carbon County.
