The identified floodplain area shall be any area of the Borough
of Summit Hill subject to the 100-year flood, which is identified
as Zone A (Area of Special Flood Hazard) on the Flood Hazard Boundary
Map (FHBM) dated December 14, 1979 (or the most recent revision thereof),
as issued by the Federal Emergency Management Agency (FEMA), or on
the most recent Flood Insurance Rate Map (FIRM) issued by FEMA, if
such a map has been prepared for the Borough.
The identified floodplain area may be revised or modified by
the governing body where studies or information provided by a qualified
agency or person documents the need for such revision. However, prior
to any such change, approval must be obtained from the Federal Insurance
Administration (FIA).
Should a dispute concerning any identified floodplain boundary
arise, an initial determination shall be made by the municipal Planning
Commission and any party aggrieved by this decision may appeal to
the governing body. The burden of proof shall be on the appellant.
