As used in this chapter, the following terms shall have the
meanings indicated:
BOROUGH
Includes Borough Council members, Mayor and their designees.
PARK
Refers to any grounds, walls, fences and walks under the
control of the Borough of Summit Hill as identified herein. Said definition
shall also include for purposes of the Phillip Melley Memorial Park
all roadways immediately adjacent thereto.
The following rules and regulations are hereby established in
order to preserve the life, health and property of persons and to
maintain the public peace in and about the Borough parks known as
"Ludlow Park," "Bill Black Park," "Phillip Melley Memorial Park" and
"Ginder Park":
A. During the months of October through April, the parks shall be open
to the public daily between the hours of 6:00 a.m. and 6:00 p.m.,
at which time all activities shall cease immediately. Except for those
specifically authorized by the Borough, no persons shall be in the
parks after 6:00 p.m. or before 6:00 a.m. the next morning;
B. During the months of May through September, the parks shall be open
to the public daily between the hours of 5:00 a.m. and 9:00 p.m.,
at which time all activities shall cease immediately. Except for those
specifically authorized by the Borough, no persons shall be in the
parks after 9:00 p.m. or before 5:00 a.m. the next morning;
C. No person shall injure, deface, remove, cut or damage any of the
trees, plants, shrubs, turf, buildings, structures or fixtures therein
or any other property owned by the Borough located within the park;
D. No person shall remove any bench, seat or table from the parks or
change the location thereof without permission from the Borough;
E. No person shall conduct himself within the parks or adjacent sidewalks,
road surfaces or grassy areas so as to annoy any other person using
the parks for recreational purposes or persons residing adjacent to
said parks;
F. No person shall hold any meeting or gathering, assembled through
advertisement or public notice, or any gathering otherwise assembled
and composed of 25 or more persons, within the limits of the parks
without having first made application to the Borough thereof for a
permit;
G. No person shall set up any booth, table or stand for the sale of
any article whatsoever within the limits of the parks without the
consent of the Borough, who shall have the authority to refuse such
consent in any instance;
H. No person shall dispose of any waste or garbage in the parks, except
in receptacles designated for the respective purposes. All persons
using the parks shall dispose of all waste and garbage left by them
in such proper receptacles. No household waste or garbage shall be
deposited in any receptacles within or adjacent to any parks;
I. No person shall injure, deface or destroy any notice, rule or regulation
posted at any place within the parks by the authority of the Borough
or any other authority of the Borough; nor shall any person post,
at any place within the parks, any notice or placard other than by
the authority of the Borough;
J. No person shall bring any alcohol beverages into the parks, either
for his own use or for the use of any other person, except as permitted
by the Borough;
K. No person, other than an officer of the law, shall carry any firearm
within the limits of the parks, nor shall any person engage in hunting
from within the parks or any surrounding area; and
L. No person shall allow or permit any animals to enter and/or remain
in any Borough parks at any time.

Any person who shall violate any of the rules and regulations
as heretofore set forth shall, upon conviction in a summary proceeding
under the Pennsylvania Rules of Criminal Procedure, be guilty of a
summary offense and shall be punishable by a fine of not more than
$1,000, plus court costs and reasonable attorneys' fees incurred by
the Borough in the enforcement proceedings. Upon judgment against
any person by summary conviction, or by proceedings by summons on
default of the payment of the fine or penalty imposed and the costs,
the defendant may be sentenced and committed to the Borough correctional
facility for a period not exceeding 10 days or to the county correctional
facility for a period not exceeding 30 days. Each day that such violation
exists shall constitute a separate offense, and each section of this
chapter that is violated shall also constitute a separate offense.
In addition to or in lieu of enforcement under this section, the Borough
may enforce this chapter in equity in the Court of Common Pleas of
Carbon County.
