As used in this article, the following terms shall have the
meanings indicated:
ASHES
The residue from coal or other fuel.
DWELLING
A house or other building designed or used primarily for
human habitation.
DWELLING UNIT
Any dwelling or portion thereof, used or intended to be used
by one family and providing complete housekeeping facilities thereof.
FAMILY
One or more individuals occupying a premises and living as
a single nonprofit housekeeping unit.
GARBAGE
Every waste accumulation of animal, vegetable, fruit or similar
organic matter that attends the preparation, use, cooking, dealing
in meat, fish, fowl, fruit or vegetable.
PERSON
Any natural person, firm, copartnership, association or corporation.
RECYCLABLES
Plastics, glass and clean cans, with no lids, also newspapers,
magazines, inserts, junk mail, computer paper and cardboard, etc.
REFUSE
Inorganic waste, such as earth, stone, dangerous materials,
such as poisons, acids, explosives, solid waste resulting from an
industrial process and materials not prepared in accordance with the
chapter.
RUBBISH
Includes wood, rubber, cloth, leather or any other similar
combustible material.
The following refuse shall not be considered for collection.
A. Materials resulting from the repair, construction, alteration or
excavation of buildings or structures, street or sidewalks, such as
earth, plaster, mortar, concrete, bricks, lath and roofing materials.
B. Dangerous materials or substances, such as poisons, acids, caustics,
infected materials and explosives.
C. Materials which have not been prepared in accordance with the provisions
of this article or all laws from Dutchess County pertaining to garbage
and recycling.
D. Trees or tree trimmings, leaves, shrubs or barks thereof, and grass
clippings, as these materials can be brought to landfill by permit.
E. Solid waste resulting from industrial processes.
The Board of Trustees shall have the right, from time to time,
to contract with one or more persons, upon such terms and conditions
as it deems advisable, for the collection and disposal of recycling,
ashes and garbage within the Village, subject to the provisions of
the General Municipal Law of the State of New York.
The owner, lessee, tenant or any other person having the management
or control of or occupying any lot or plot of land in the Village
shall keep such land at all times free and clear of any accumulation
of ashes, rubbish, refuse, grass cuttings, tree cuttings, leaves,
garbage, offal or any offensive substances, except such as are deposited
in containers or are otherwise secured as provided for in this article.
Any person, firm or corporation who shall violate any of the
provisions of this article shall, upon conviction, be punishable by
a fine of not more than $250 or imprisonment for not more than 15
days, or both. Each day of continuance of an offense shall be considered
a separate offense.
The Village will continue to pick up leaves in the fall and
collect Christmas trees in January. These dates will be properly noted
in the newspapers. The landfill will be open, if at all possible,
for disposal of grass clippings, light garden debris and leaves by
Village residents.
