The Board of Trustees of the Village of Bath does hereby prohibit the operation of autotrucks, wagons and other vehicles used for the hauling of ashes, rubbish and garbage in and upon the streets of the Village of Bath, New York, without a license.
A. 
The Village Clerk of the Village of Bath shall issue such a license for one year to any person owning or operating such vehicle(s) for the purposes aforesaid upon the payment by the applicant of a fee of $50 per vehicle for that period.

B. 
All licenses shall expire on December 31 of each year.
C. 
The license fees established in § 63-2A above may be amended from time to time by resolution of the Village of Bath Board of Trustees.

A. 
Said license shall be granted and issued by the Village Clerk only after the vehicle or vehicles to be licensed shall have passed an inspection by the Chief of Police as to the proper equipment of said vehicles in accordance with this article and in accordance with the laws of the State of New York, and no such license shall be issued unless and until the Chief of Police shall have certified the vehicles to be in a safe condition and to have the necessary and proper equipment as prescribed by this article and the laws of the State of New York.
B. 
Vehicles licensed under the provisions of this article shall be reinspected at least once annually, and no license shall be renewed until the Chief of Police has certified that the vehicle meets the requirements specified above.
Each vehicle shall be so equipped and constructed that there will be no spilling of garbage, rubbish, ashes or other refuse on the Village streets. Each such vehicle shall be equipped with a suitable canvas, tarpaulin or other appropriate covering to prohibit the spilling of refuse, etc., and when said vehicle is being used for the purpose of hauling garbage, rubbish, ashes, etc., said canvas, tarpaulin or other covering shall at all times be placed over the rubbish, etc., and securely tied to prevent said spilling.
All such trucks, wagons, boxes and receptacles shall be subject to inspection at all times by the police or other officers of the Village.
No licensed garbage carrier shall dump his load except at the landfill operated by Steuben County and available for use by the residents of the Village of Bath.
All licensed garbage carriers shall maintain such equipment as may be necessary in order to participate in the recycling program as established by the Trustees of the Village of Bath or the State of New York. All carriers shall be equipped to separate and segregate various recyclable materials and to participate in the recycling program. All carriers licensed by the Village shall pick up recyclable materials segregated by the customer, and no additional fee or charge shall be collected on account of such participation.
A. 
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
In addition, or as alternative to the above-provided penalties, the Board of Trustees may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this article.

A. 
It shall be unlawful for any person to discard, drop or throw any refuse, rubbish, trash or debris in any area owned by the Village of Bath and used for the purpose of a public park or cemetery.
B. 
It shall be unlawful for any person to discard, drop or throw any refuse, rubbish, trash or debris in any garbage can, receptacle or dumpster without the authority to do so with the intent to avoid paying for garbage carrier service.
This article is hereby declared to be for the preservation of peace, health and safety and a police regulation therefor.
