This chapter shall be known and may be cited as the "West Mifflin Borough Subdivision and Land Development Ordinance."
This chapter is established for the purpose of assuring sites suitable for building purposes and human habitation; to provide for the harmonious development of the Borough in accordance with the Comprehensive Development Plan; for the coordination of existing development with proposed development within the Borough; and for adequate open spaces, for proper traffic flows, recreation, light and air, and for proper distribution of population, thereby creating conditions favorable to the health, safety, morals, and general welfare of the citizens.

Hereafter, no activity covered by this chapter shall be permitted, no land shall be subdivided, no land shall be developed, nor improvements to land laid out, constructed, opened or dedicated for public use or travel, or for the common use of occupants of buildings or properties abutting thereon, except in strict accordance with the requirements and procedures of this chapter. This chapter applies to the subdivision of land into three or more parcels. The subdivision of a parcel of ground into no more than one additional parcel shall conform to only those requirements specifically set forth by the Planning Commission, but, in all cases, the minimum plan requirements as specified in § 250-13A and B shall apply. However, once a subdivision has taken place, any future subdivision must conform to all the regulations stipulated in this chapter; provided, however, that any subdivision which was approved or recorded in the Allegheny County Recorder of Deeds office or any portion of a subdivision where the streets, sanitary sewer and storm sewer collection systems, public utility lines, public parks and recreational areas were not actually constructed or installed or governed by a viable or enforceable developer's agreement with the Borough of West Mifflin where the streets and storm and sewer collection systems were not dedicated and/or accepted as public improvements by the Borough of West Mifflin as of the date of this chapter shall be null and void for the purpose of this chapter, and henceforth, any land or building activity or any land development shall not be undertaken or permitted without submitting a new preliminary subdivision or development plan as required in Article III of this chapter and in full and strict compliance with all requirements and procedures of this chapter, as amended.
Chapter 290, Zoning, Chapter 141, Grading and Excavation, standards for construction and other applicable ordinances and regulations of the Borough as presently enacted and amended from time to time are incorporated herein and made a part hereof by reference.
Whenever there is a difference between the minimum standards specified herein and those included in other Borough ordinances and regulations of the Commonwealth of Pennsylvania and the County of Allegheny, the more stringent requirements shall apply.
The layout or arrangement of the subdivision or land development shall conform to the Official Plan and to any regulations or maps adopted in furtherance thereof, including, but not limited to, Chapter 290, Zoning.
Hereafter, no lot in a subdivision may be sold; no permit to erect any building upon land in a subdivision may be issued; no cuts, grading or filling permitted; no street, walkway, curb, gutter, streetlight, fire hydrant, shade tree, sanitary sewer, storm sewer, waterline or other improvement as may be required shall be constructed or guaranteed, except in accordance with this chapter.
A. 
Hereafter, except as provided in this chapter, any plan of any subdivision, street or development of land not approved by the Planning Commission or Borough Council in accordance with the provisions and procedures as set forth herein shall be null and void.
B. 
In addition, when a preliminary application has been duly approved, the applicant shall be entitled to final approval in accordance with the terms of the approved preliminary application as hereinafter provided. However, if an application is properly and finally denied, any subsequent application shall be subject to the intervening change in governing regulations.
