The Office of Township Manager is hereby created, subject to
the right of the Township, by ordinance, at any time to abolish said
Office.
The appointment to said Office of Township Manager shall be
by a majority vote of the Board of Commissioners.

The Board of Commissioners may enter into a contract of employment
with the appointed Township Manager. Said contract may be for a period
of up to 3 1/2 years and shall set forth the salary and terms
of employment, one of which will be that either party may terminate
the contract prior to its expiration.
Before entering upon his duties, the Township Manager shall
give a bond to the Township of Upper Chichester, with a surety company,
approved by the Township Solicitor, in the sum of $10,000, conditioned
for the faithful performance of his duties.

The Township Manager shall receive such compensation as is fixed
by the employment contract entered into between the Township and the
Township Manager.
The Township Manager shall perform the following duties and
shall have the following responsibilities:
A. The Township Manager shall see that all laws and ordinances are enforced.
B. The Township Manager shall make recommendations to the Board of Commissioners
concerning the affairs of the Township, and shall make reports of
the activities of all departments of government to the Township Commissioners.
C. The Township Manager shall prepare and submit a proposed annual budget
to the Board of Commissioners.
D. The Township Manager shall be responsible for the general management
of all Township business not expressly, by statute or ordinance, imposed
or conferred upon other Township officers or employees.
E. The Township Manager in preparation of the proposed annual budget
and in preparation of any financial reports or financial recommendations,
shall confer with the various Commissioners about the committees of
which they are Chairman, and the Township Manager shall base his reports
on the conferences held with the various Commissioners concerning
their committees and departments.
F. The Township Manager shall attend all meetings of the Board of Commissioners
and shall attend, as far as possible, all meetings held by any governmental
group in the Township of Upper Chichester.
G. The Township Manager shall have and perform such other duties as
the Board of Commissioners may, from time to time, assign to him.

The Township Fire Marshal shall be appointed by the Township
Fire Commissioner at a regular monthly meeting. The Township Fire
Marshal shall serve a six-year term. At the end of the term, he may
then be reinstated or a new person will be elected to fill the position
for a six-year term.
The Township Fire Marshal shall be picked by the Fire and Police
Board Committee. He or she will hold this position for the full term
unless voted out by the Fire and Police Board Committee and Township
Chiefs by a four-to-two vote. This panel shall consist of the Chief
of each company and the three Commissioners who serve as the Fire
and Police Board.
The following minimum education and experience shall be necessary
to qualify for appointment to the office of Township Fire Marshal:
A. Education.
(1) Shall have a valid high school diploma.
(2) Shall be able to speak and read English.
(3) Shall have completed the Basic Fire Fighting School.
(4) Shall have completed the Advanced Fire Fighting School.
(5) Shall have completed the Commonwealth of Pennsylvania Arson Detection
School.
(6) Shall have completed an approved course in hazardous materials.
B. Experience.
(1) Shall have at least five years as a firefighter.
(2) Shall have served at least one year as an Assistant Fire Chief.
(3) Shall have served at least two years as a Fire Chief.
(4) Shall have served at least one year as a Township Fire Chief.
A. The Board of Commissioners shall decide on a yearly operating budget
for the Fire Marshal to work with.
B. The budget shall be used for equipment, office supplies, schooling,
vehicle mileage, and for fire prevention material, and other supplies
and material deemed necessary to carry out the duties of Township
Fire Marshal.
The Code of the Township of Upper Chichester and the Pennsylvania
Uniform Construction Code, as amended from time to time, shall serve
as the authoritative guides for the Township Fire Marshal.
The Township Fire Marshal shall have the following power and
duties:
A. Fire suppression. The Township Fire Chief will be in command of all
fire suppression in the Township. After the fire is declared under
control, the fire scene will then be turned over to the Township Fire
Marshal. If there is no Chief Officer on the fire scene, the Fire
Marshal will be in command until the first Chief Officer arrives on
the scene.
B. Investigation of fires.
(1) To investigate all fires which occur within the Township in order
to determine the cause thereof.
(2) To provide a copy of the investigation to the Township Fire Chief
and/or Police Chief when requested.
(3) To work with and provide the necessary support and assistance to
local and state police on fire investigations.
C. Enforcement of codes.
(1) The Township Fire Marshal shall enforce the Pennsylvania Uniform
Construction Code, as amended from time to time.
(2) To inspect all buildings and all properties and to enforce the State
and Township Fire Code.
(3) To assist firefighting units by surveying buildings and recording
their construction, occupancy, hazards, and fire protection systems.
The Township Fire Marshal shall advise the area fire companies of
this information, and shall arrange tours if requested.
D. Insurance rating authorities. To consult with the insurance companies
and to convey to the Board of Commissioners the requirements for fire
protection which are acceptable to the insurance ratings authorities.
E. Public education. To develop and conduct public education programs
on fire safety.
F. Records and evidence.
(1) The Fire Marshal shall keep records of all inspections, fires, and
hazardous material incidents, and shall inform the Township Fire Chief
and Fire Commissioner of all inspections.
(2) To maintain a record(s) on file at the Township Municipal Building
of any and all investigations and/or reports relating to the duties
of his office.
(3) If, in the opinion of the Fire Marshal, photographs of a scene are
required, he shall take such pictures or, if necessary, request the
Township Police or other agents to provide the necessary photographs.
The Township Fire Marshal shall also serve as the Assistant
State Fire Marshal.
In the absence of the duly appointed Fire Marshal, the Township
Fire Chief shall assume the duties of the Township Fire Marshal.
The Township Fire Chief and his assistants shall assist the
Township Fire Marshal in the enforcement of the administrative codes.
