A. Within one year after a public water system is made available by the Town of Ocean View, the owners of all dwellings, buildings, or other structures used for human occupancy, employment, recreation or other purposes situated in the area served by the Town are hereby required to install a suitable water supply system and to connect such system directly with the proper Town water main. Upon the expiration of one year, notice shall be given to those owners who have not connected that they are required to do so within 60 days after the date of official notice. If no connection shall have been made, the penalty fees set forth in Subsections
B and
C below shall be imposed by the Town, and the Town Solicitor shall take such actions is as appropriate to compel connection.
B. Those owners failing to comply with Subsection
A of this section shall incur a quarterly penalty fee of $500 along with interest in the amount of 1.5% per month until connection is completed.
C. Those owners who have obtained a utility permit but have failed to comply with Subsection
A of this section shall incur a quarterly penalty fee of $250 along with interest in the amount of 1.5% per month until connection is completed.
All necessary plumbing work to be done in connecting
any property shall be done by a plumber licensed to do business in
this state, in a good and workmanlike manner, and with good and proper
materials, and shall be subject to the approval of the Town or its
designee.

The owner of any dwellings, buildings, or other
structures used for human occupancy, employment, recreation or other
purposes required to be connected to the water service provided by
the Town may maintain and use a private well located on the owner's
property for the purpose of irrigation, car washing or the like, upon
the condition that it be disconnected from any dwelling, internal
household plumbing, building, or other structure connected to the
Town's water system and that it shall be permitted by all other applicable
laws, rules, or regulations of this or any other jurisdiction relating
to the use of such wells.

It shall be lawful to construct, install and operate a private
well in the Town of Ocean View, subject to the following conditions:
A. The well
shall be used for irrigation purposes only;
B. The well
shall have no connection to the Ocean View water system or to any
other water utility’s service connection or to any dwelling,
building or other structure required to be connected to the Ocean
View water system or to any other water utility’s service connection;
C. The well
and all plumbing shall be inspected by the Town upon completion of
the irrigation system and the installation of the well; and
D. The well
shall have received all required permits from the State of Delaware
or other governmental entity having jurisdiction over the subject
matter of this section.
