The purpose of this chapter is to designate certain parking
locations within the Township of Jackson as permit parking areas and
to regulate the use of such parking locations in a manner which encourages
use by Township residents.
There are hereby created and established in the Township of
Jackson facilities or zones for the parking of motor vehicles on lots
now or hereafter owned or rented by the Township for that purpose.
A.
Any person who desires to park a motor vehicle in a municipal lot
or zone shall purchase from the Township Clerk, or designee, a permit
which shall be displayed on the back of the rearview mirror of each
vehicle parked in a municipal parking lot in such a manner as to be
clearly visible thereon. The Clerk shall have the authority to determine
the form of said permits. An applicant for such a permit may request
a duplicate permit for another motor vehicle which is registered in
the same name. Only one duplicate per permit is allowed. Said duplicate
permit shall be distinguishable from the original permits issued by
the Clerk. The Clerk is authorized to issue replacement permits where
a permittee wishes to substitute a vehicle different from the one
for which the original permit was issued. In a case where a motor
vehicle with a permit must be in a repair shop for any lengthy period
of time, a temporary thirty-day sticker may be issued.
B.
Permit fees.
(1)
There shall be no permit fee for Township residents. Resident permit
applicants shall show to the Clerk, or designee, satisfactory evidence
of Township residence.
(2)
The annual permit fee for nonresidents shall be $200. Said permit
shall terminate on December 31 of the year of issuance. The Clerk
is permitted to adjust and prorate fees on a quarterly basis within
the calendar year for which the permit is sought beginning April 1
of the year of issuance. This provision shall not empower the Clerk
to issue permits for less than the balance of the year for which the
permit is sought. The fee for the issuance of a duplicate permit is
$5, and the fee for the issuance of a replacement permit is $3. In
the case of a temporary permit to be issued to a permit holder, the
fee shall be $2. A one-day daily permit may also be issued for a fee
of $10.

C.
Annual renewal. Persons desiring to purchase a permit for the next
ensuing calendar year may purchase same on and after December 1 of
the proceeding year.
A.
The permit shall only authorize the parking of vehicles at the designated
locations weekdays.
B.
The permits to be sold by the Clerk under the terms of this chapter
are intended to apply to one parking space, and no person shall park
a motor vehicle of such size or in such a manner as to occupy more
than one such parking space. Further, motor vehicles shall be parked
head-in into the parking space so that the rear bumper of the vehicle
abuts traffic aisles. The issuance of a duplicate permit by the Clerk
shall not entitle the permittee to park more than one vehicle in a
parking facility at one time.
C.
Each person applying for a parking permit hereunder shall complete
an application form to be prepared by the Clerk which shall set forth
the name, address, and driver's license number of the applicant
for the motor vehicle to which the permit is to apply, including a
description of each motor vehicle by year, make, model, color, and
license plate number. At the time of applying for said permit, an
applicant shall present to the Clerk the current New Jersey motor
vehicle registration and insurance identification card for which a
permit is sought. (Vehicles must be registered to one person.) Under
no circumstances will a refund or rebate be granted for any unused
portion of the annual pro rated parking fee.
D.
The permit stickers issued shall be affixed only to the motor vehicles
described in the application and shall not be transferable to any
other vehicle.
E.
Wherever parking has been restricted in any portion of a designated
parking lot or zone by other ordinances or resolutions presently in
effect regulating parking (such as ordinances establishing metered
areas), then said portions of the above zones shall continue to be
regulated parking areas as provided in such respective other ordinances
or resolutions, notwithstanding the provisions of this chapter.
The Director of Public Safety is hereby directed to prepare
and erect proper signs calling attention to the provisions of this
chapter along those streets or portions thereof located within the
designated parking areas.
The following vehicles shall be exempt from this chapter:
A.
Contractors, service and delivery vehicles. Contractors, service
and delivery vehicles bearing the name and address of a commercial
business and registered and licensed to do business in the Township
of Jackson, if required, and exhibiting commercial license tags may
park without a permit between the hours of 8:00 a.m. and 6:00 p.m.
during the time that the operator and/or occupants of said vehicle
are actually rendering service, repairs or improvements to a residence
or other property located within the designated parking areas. Any
commercial vehicle parked overnight shall be deemed in violation of
this chapter.
B.
Any vehicle lawfully parked in a parking space governed by a parking
meter, where the required coins have been deposited in said meter.
C.
Emergency vehicles. Emergency vehicles and public service, telephone
and other utility vehicles may park without a permit during the time
that they are rendering service or repairs in the area. Proof of service,
e.g., an invoice or other written document, must be furnished upon
request of an officer enforcing parking regulations. Any public utility
vehicle parked overnight and not providing service shall be deemed
in violation of this chapter.
A.
Any person who parks a vehicle or who permits a vehicle to be parked
in a municipal parking lot or facility in violation of the terms of
this chapter shall be subject to a fine of not more than $20 in the
discretion of the Municipal Court Judge. Further, all enforcement
officers are hereby authorized to arrange for the towing of any such
illegally parked vehicles and the owner of said vehicle shall remain
liable for all towing and storage charges associated therewith. A
separate offense shall be deemed committed each day during or on which
the violation occurs and/or continues.
B.
It shall be prohibited for any individual, corporation or other entity
to whom parking permits have been issued to duplicate, sell or lease
or otherwise transfer any permit in a manner not provided for in this
chapter. Any individual or business to whom a parking permit has been
issued that is found to have duplicated, sold, leased or otherwise
unlawfully transferred said parking permit will be subject to a fine
of $100 and/or imprisonment up to 30 days upon conviction. In addition,
all future parking privileges provided for in this chapter shall be
revoked for said individual or business.
C.
Any vehicles found to have parking permits which have been duplicated, sold or leased or otherwise unlawfully transferred shall be towed at the owner's expense. The owner of said vehicle shall receive a summons for a violation of this chapter and be subject to a penalty as provided in Subsection A above.
