A. 
The purpose of this article is to provide safeguards and protection for the safety, health and welfare of the residents of the Town and occupants of mobile homes by establishing specific requirements governing the occupancy, use, location and maintenance of mobile homes.
B. 
The provisions of this article shall supersede local laws, ordinances, codes or regulations to the extent that they are inconsistent with the provisions of this article, provided that nothing herein contained shall be construed to prevent the adoption and enforcement of a law, ordinance or regulation which is more restrictive or establishes a higher standard than those provided in this article, and such more restrictive requirement or higher standard shall govern during the period in which it is in effect.
C. 
In a case where a provision of this article is found to be in conflict with a provision of a zoning, building, electrical, plumbing, fire, safety, health, water supply or sewage disposal law or ordinance, or regulation adopted pursuant thereto, or other local law, ordinance, code or regulation, the provision or requirement which is more restrictive or which establishes the higher standard shall prevail.
As used in this article, the following terms shall have the meanings indicated:
ADDITION
A structural building component either attached to the exterior of a mobile home or designed to be used by the occupant of a mobile home, including awnings, carports, living and storage areas and covered patios.
MOBILE HOME
A single-family or individual dwelling less than 20 feet in width, designed for transportation, after fabrication, on streets and highways on its own wheels or on a truck or trailer to a site where it is to be occupied as a dwelling, complete and ready for occupancy, except for minor and incidental unpacking and assembly operations, location on jacks or permanent foundation and connection to utilities.
PERMIT
A written permit allowing a person or persons to occupy and maintain a mobile home under the provisions of this article and regulations issued hereunder.
Any dwelling, cabin or abode of any name or nature, if not included under this article, shall be subject to the rules and regulations of the Zoning Ordinance of the Town of Schroeppel.[1]

A. 
No person or persons being the owner or co-occupant of any land or premises within the Town of Schroeppel shall use or permit the use of such land or premises for the placing of a mobile home without a permit obtained as hereinafter provided.
B. 
No permit shall be issued to any person other than the owner in fee of the premises described in the preliminary application therefor.
C. 
A building permit must be acquired for any additions or enclosures as required under the Zoning Ordinance and Building Code Administration Ordinance of the Town.[1]

The provisions of this article shall not apply to a mobile home located on the site of a construction project, survey or other similar work project and used solely as a field office or work- or toolhouse in connection with such project, except that a fee of $35 per calendar year shall be paid to the Town Clerk for issuance of a permit to locate a construction site field office trailer, the same to be obtained prior to the placing of the trailer.
Application for a mobile home permit shall be made to the Town Clerk and shall contain or be accompanied by the following:
A. 
The name of the applicant and his present residence address.
B. 
The name and age of each person who will occupy the mobile home.
C. 
The make, registration number, year and model of the mobile home.
D. 
A general description of the property on which the proposed mobile home will be located.
E. 
A sketch map of the property showing:
(1) 
The general plan of the proposed site, including the location of the home and attendant service facilities.
(2) 
Abutting property owners and the present use of the property.
(3) 
Any unusual special land features, such as streams, creeks, areas subject to flooding and areas of steep slopes in excess of 15°.
A. 
Upon receipt of the completed application and the fee required by § 86-17A, the Town Clerk shall forward said application to the Building Inspector, who shall forthwith inspect the site in question for compliance with the provisions of this article and submit his recommendation to the Town Board.
B. 
The Town Board, upon receiving the application and the recommendation of the Building Inspector, shall review the application and approve or disapprove the issuance of a permit within 30 days.
A. 
Issuance of permit. The Town Clerk shall issue permits after approval thereof by the Town Board.
B. 
Transfers; sales. Any mobile home hereafter moved into the Town of Schroeppel shall be for the personal use and occupancy of the person applying for such license and members of his household, and no permit shall be transferred. In the event of a sale of any mobile home licensed by the Town of Schroeppel, the permit therefor shall expire immediately and the person purchasing such mobile home shall within 10 days apply to the Town Clerk for a new permit for the maintenance of a mobile home in the Town of Schroeppel and at that time turn in the previous permit.
C. 
Rental and use. No mobile home for which a permit has been issued by the Town of Schroeppel shall hereafter be rented or used by any person other than a person to whom a mobile home permit has been issued or the members of his immediate family, unless specifically authorized by the Town Board.
A. 
An occupancy permit shall be obtained from the Building Inspector, Zoning Officer or such other Town official as may be designated by the Town Board after the mobile home has been placed on the site but before being occupied by any person.
B. 
The application for such occupancy permit, which may be obtained from the Town Clerk or Zoning Officer, shall contain the following:
(1) 
A copy of the legal description of the property on which the mobile home is located.
(2) 
A sketch map showing the location of the mobile home and attendant service facilities, such as drain fields, electric service poles, water supply or any other buildings.

A. 
A filing fee in an amount as separately established by resolution by the Town Board shall accompany the application for a mobile home permit, which shall be retained by the Town Clerk and be nonrefundable.
B. 
An additional fee in an amount as separately established by resolution of the Town Board shall be paid to the Town Clerk upon receiving an occupancy permit signed by the Building Inspector or Zoning Officer or any other officer designated by the Town Board.

A. 
General requirements. All land used for a mobile home site shall be well drained, of ample size and free from heavy or dense growth of brush or woods. The land shall be properly graded to ensure rapid drainage during and following a rain.
B. 
Location with regards to general area. No mobile home shall be located or maintained in any district or location in the Town of Schroeppel unless the living area of such mobile home coincides with that of other dwellings in the district or general area which now exist or which may be established by the Zoning Ordinance of the Town of Schroeppel, as it may from time to time be amended.[1]

C. 
Not more than one mobile home shall be permitted to park or otherwise locate on each separate lot or parcel of land.
D. 
Size of lots and yards. Every lot shall meet the following minimum requirements:
(1) 
The area required per mobile home shall be the same as required for dwellings in the existing Zoning Ordinance, which is 15,000 square feet.
(2) 
Front, side and rear setbacks shall conform to the existing Zoning Ordinance with reference to residential requirements.
E. 
Driveways. Suitable driveway(s) shall be constructed in conformity with the existing Zoning Ordinance and the Street Excavations and Driveways Local Law of the Town.[2]

A. 
Minimum size. Any mobile home on an individual site shall contain no less than 500 square feet of living space.
B. 
Travel trailers, camp trailers, tent trailers and chassis-mounted trailers, by any name known or devised, shall not be used as a mobile home or converted to a residence.
C. 
Skirts. Each mobile home owner shall be required to enclose the bottom portion of the mobile home with a skirt constructed of metal, wood or durable material, properly ventilated, upon arrival of the mobile home on the site and prior to occupancy.
A. 
Water. An adequate supply of water shall be provided for the mobile home and other accessory buildings as required by this article. Where public water is available, connection to such source shall be used exclusively, unless local authorities deem otherwise. If a public water supply system is not available, the development of a private water supply system shall be approved by the health authority and other authorities having jurisdiction thereof.
B. 
Sewage. An adequate and approved sewage disposal system shall be provided on all sites for the conveying and disposing of sewage from the mobile home. Such systems shall be designed, constructed and maintained in accordance with Department of Health standards and regulations.
C. 
Sanitation.
(1) 
General requirements. Mobile home sites shall be maintained in a sanitary and orderly condition at all times.
(2) 
Garbage and refuse. Each mobile home owner shall make provisions for sanitary equipment to prevent littering of the grounds and premises with rubbish, garbage and refuse. Each mobile home shall have containers with tight-fitting covers. Regular disposal shall be provided for all rubbish, trash and garbage.
Every site shall contain an electrical wiring system consisting of wiring fixtures, equipment and appurtenances which shall be installed and maintained in accordance with the local electric company's specifications and regulations. All wiring fixtures and connections must have the approval of local power companies, the New York Board of Fire Underwriters or such other authority as may be designated by the Town.
A. 
Fuel oil supply system.
(1) 
General requirements. All fuel oil supply systems provided for a mobile home, service buildings and other structures shall be installed and maintained in conformity with the rules and regulations of the authority having jurisdiction when provided.
(2) 
Specific requirements.
(a) 
All fuel oil tanks shall be hidden from view.
(b) 
Supports or standards for fuel storage tanks are to be of a noncombustible material.
(c) 
All fuel oil tanks shall be equipped with Firematic valves or an approved equivalent.
B. 
Natural gas supply.
(1) 
Natural gas piping systems installed to the mobile home shall be maintained in conformity with accepted engineering practices.
(2) 
Each mobile home site provided with piped natural gas shall have an approved shutoff valve and cap to prevent accidental discharge of gas.
(3) 
Proper planning and early communication with the utility company is recommended to provide necessary easements for utility companies, i.e., gas, electric and telephone.
C. 
Liquefied gas supply.
(1) 
Such systems shall be provided with safety devices to relieve excessive pressures and shall be arranged so that the discharge terminates at a safe location.
(2) 
Systems shall have at least one accessible means of shutting off gas. This means shall be located outside the mobile home.
(3) 
All liquid propane gas facilities shall be well supported and protected against mechanical injury.
