The system of sanitary sewers heretofore authorized and constructed within the Borough of Trainer, together with other sanitary sewers used by and serving the Borough of Trainer, is hereby ordained and established as the sanitary sewer system of the Borough of Trainer, together with such additions as shall hereafter be added to such system.

A. 
Each person who shall own property connected with and served by the sanitary sewer system of the Borough of Trainer and each property or unit so connected shall be charged a rate, to be established each year by ordinance, per 1,000 gallons or faction thereof of water consumed or discharged per annum, which charges shall be paid to the hereinafter named collector as provided by law.
B. 
Said sewer rentals shall be collected by the duly appointed Treasurer of the Borough of Trainer.
C. 
The charge or rental set forth hereinafter shall be billed to each user semiannually. The billing dates shall be April 15 and October 15 of 1980, and each succeeding year. Said bill must be paid to the collector within 30 days from each billing date.
D. 
A ten-percent penalty will be added to the sewer rental if not paid within 30 days of the date of the bill; and if installment plus penalty is not paid within 60 days after the date of the bill, the aggregate amount thereof shall bear interest from the penalty date at the rate of 1% per month or fraction thereof.
E. 
All rental charges, interest and penalties shall be a lien against the properties so connected and served until paid. Said lien shall be enforced and collected as provided by law.
F. 
In the event that an ordinance establishing a rate to be charged to those connected with and served by the sanitary sewer system of the Borough of Trainer is not enacted for any particular calendar year, the rate imposed by the most recent ordinance enacted shall continue to be in effect for each and every year that an ordinance has not been enacted until such time as a new ordinance is enacted establishing a different rate.
The collector shall procure, at the expense of the Borough, all necessary books, records, bills and other forms of stationery and keep a proper record of all assessments, charges, service rates and rentals and all payments hereunder, whether collectible by the Collector or the Solicitor or otherwise. The Collector and the Solicitor shall report to the Council, monthly, all payments received.
The Collector shall mail to the owner of each property at his last known address or, if the owner's address be unknown, to the address of the property a bill for the rental chargeable to the property owner, property or unit, as provided by law. Failure of the owner to receive such bill shall not relieve such owner from liability for payment in accordance with the provisions of this article.
All monies, including penalties, collected hereunder shall be deposited in a fund to be known as the "Sewer Rental Fund" and shall be applied as follows:
A. 
The payment of the annual principal and interest on any bond issue incurred for the sanitary sewer system of the Borough of Trainer.
B. 
The payment of any sums which shall become due under the existing contract between the Borough of Trainer and The Delaware County Regional Water Quality Control Authority or any authority hereafter created for the purpose of acquiring, holding, constructing, improving, owning, maintaining, operating or leasing any sewer, sewer system or sewage treatment works.
C. 
The maintenance, repair, alteration, inspection, depreciation and all other expenses of the Borough in relation to its sewers, outfall sewers, and sewer system, including any unpaid loans of the preceding year made for either of the foregoing purposes and any lawful deficits incurred for sewer, sewer system or sewage treatment works.

Residential users and industrial users shall be charged the following sewer charge or rental for the calendar year 1980:
A. 
Each and every residential user shall be charged at a unit rate of $2.30 per 1,000 gallons of water consumed or fraction thereof. The first 1,500 gallons of water consumed shall be exempted from any charges. However, the minimum charge regardless of the amount of water consumed shall be $20 per year.
B. 
Each and every industrial user shall be charged at a unit rate of $2.30 per 1,000 gallons of sewerage times a surcharge factor as follows:

The adjusted sewer rate is computed by:
Adjusted Sewer Rate = Base Sewer Rate x Surcharge Factor
The actual charge for service is computed by:
Service charge = Actual gallons of sewage discharged multiplied by the adjusted sewer rate
The amount of sewerage discharged shall be determined by the actual sewerage effluent meter readings as supplied to the Borough by the user as specified in § 207-18 as set forth hereinafter.
A. 
For the calendar year 1980 and each succeeding year, the sewer charge or rental for each and every residential user shall be computed by using the water consumption data of the Chester Water Authority for the period of January 1 to December 31 of the prior year.
B. 
For the calendar year 1980 and each succeeding year, the sewer charge or rental for each and every industrial user shall be computed by using the most recent six-month reporting period data prior to the billing date.

A. 
The sewer rental charge applicable to any property for which there is a change in residential users shall be recomputed for the calendar year in which the change occurs as follows, unless otherwise provided in Subsection B or C hereof:
(1) 
The annual sewer rental charge previously established according to this article for the last residential user of the subject properties shall be divided by 365 to obtain a daily charge. The daily charge shall be assessed for each day of the year in which a change in residential users. From and after the date on which the new residential user obtains the status of new residential user, the daily charge for the remainder of the calendar year in which the change in residential users occurs shall be computed as follows:

B. 
In the event that the change in residential users shall occur on or after the date on which the first semiannual bill for the sewer rental has been mailed by the Borough to the residential user but on or prior to June 30 of the year in which the change occurs, the average daily rate applicable to the last residential user as established according to Subsection A(1) hereof shall be assessed for each day from and after January 1 up to and including June 30 of the year in which the change in residential users occurs. From and after July 1 and up to and including December 31 of the said year, the daily rate applicable to the new residential user as established according to Subsection A(1) hereof shall be assessed.
C. 
In the event that the change in residential users shall occur on or after the date on which the second semiannual bill for sewer rental has been mailed by the Borough to the residential users, there shall be no recomputation of the sewer rental charge for the year in which the change in residential users shall occur.
D. 
The sewer rental charge applicable for the period January 1 through December 31 immediately after the calendar year in which the change in residential users occurs shall be computed as follows:

E. 
It shall be presumed that each member of the household of a new residential user consumes 60 gallons of water per day.
F. 
A "new residential user" is a residential user who has not received the services of the sewers or sewer system of the Borough of Trainer in connection with the subject property for a complete period, January 1 through December 31.
G. 
A "last residential user" is the party who was a residential user immediately prior to the new residential user.
H. 
The taxing authority shall have the power to compute the sewer rental charge for any new residential user on the basis of the new residential user's water consumption record with the Chester Water Authority if such record is for a period of at least 180 days. This section shall only be applicable if it appears, after reasonable investigation, that the presumption contained in Subsection E hereof is not accurate as applied to the particular residential user and, further, that the actual amount of water consumed by the new residential user averages in excess of 65 gallons of water per day per member of the household.
I. 
The 1,500 gallons of water exemption as provided for in § 207-15A shall be applicable to any property only one time per calendar year. Therefore, in the event that a change in users occurs during the calendar year, a new exemption shall not apply.
A. 
Each and every industrial user shall install and maintain, at its own expense, a suitable manhole or other facility for the purpose of observing, measuring and sampling the wastewater. Each such manhole shall be safely located and shall be accessible 24 hours per day to the Borough for inspection. The flow metering equipment shall provide continuous metering and provide accuracy within plus or minus 5% of any current actual flow, and shall include a totalizer and recorder for recording cumulative flow. All equipment shall be approved by the Borough. The flow sampling equipment shall be capable of providing a twenty-four-hour composite sample.
B. 
All measurements, tests and analyses of the characteristics of the wastewater shall be determined by a statistically valid frequency of samples and in accordance with the latest edition of "Standard Methods for the Examination of Water and Wastewater."
C. 
Sampling and testing shall be done on a monthly basis and reported to the Borough semiannually. Test results and flow quantities shall be reported as a monthly average over the preceding six-month period. Deadline dates are to be established to allow enough time for computation of semiannual billing.
D. 
If any industrial user shall fail, refuse or neglect to adhere strictly to the foregoing requirements, the Borough may order such industrial users to disconnect from the sanitary sewer system of the Borough.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this article continues shall constitute a separate offense.
