This article shall be known as "The Borough of Trainer Hazardous Waste Disposal Ordinance" and shall regulate all hazardous waste, as defined hereinafter, in the Borough of Trainer.
As used in this article, certain words are defined as follows:
BOROUGH
The Borough of Trainer, Delaware County, Pennsylvania.
DISPOSAL
The storage, transfer and/or processing or reprocessing of chemicals and/or other wastes that are hazardous.
HAZARDOUS WASTE
Any chemical or other waste, natural or man-made, which has the potential to harm man, mankind and/or the environment. This includes all hazardous waste which the United States Environmental Protection Agency and/or the Pennsylvania Department of Environmental Protection determines is hazardous. Following is a partial list of hazardous waste to be regulated by this article:
A. 
Polycholorinated biphenyls (PCBs).
B. 
Pesticide wastes.
C. 
Cyanides.
D. 
Heavy metals.
E. 
Phenols.
F. 
Hexachlorabenzene (HCB).
G. 
Hydrogen sulfide.
SITE
A single geographic location that is confined by natural and/or man-made barriers.
All licensees under this article must keep accurate records of all hazardous waste which they receive. These records must include the following:
A. 
Source of hazardous waste: name and address where it came from, including the hauler.
B. 
Type(s).
C. 
Quantity(ies).
D. 
Disposition of waste, including names and address of transfer agent(s) and sites.
E. 
Dates and times must be included on Subsections A through D above.
No person, partnership or corporation shall permit a person, partnership or corporation other than a licensed disposer of hazardous waste to store, transfer and/or process or reprocess hazardous waste.
A. 
No person, partnership or corporation shall store, transfer, process or reprocess hazardous waste within the Borough except when authorized through possession of a currently validated license from the Board of Health for such purposes. Any person, partnership or corporation in the possession of a valid disposal license who fails to comply with the provisions of this article may have such license either revoked or suspended by the Board of Health. At any time during the licensing period, inspections will be made of all disposal licensed sites as frequently as necessary to ensure compliance with this article.
B. 
All licenses shall expire on May 1 of each year.
C. 
All licensing and/or permit requirements by the United States Environmental Protection Agency and the Pennsylvania Department of Environmental Protection must be met prior to the issuance of a license by the Board of Health.
D. 
The Board of Health will coordinate inspections with the United States Environmental Protection Agency and/or the Pennsylvania Department of Environmental Protection whenever the Board of Health deems it necessary.
E. 
The Board of Health will not issue a license under this article until the application has been approved by Borough Council.
F. 
The license is not transferable.
G. 
The license must be displayed at all times prominently on the licensed site within the Borough.
H. 
A license must be obtained for each site.
A. 
The license and inspection fees shall be as follows:
(1) 
License fee: $300.
(2) 
Inspection fee: $50.
(3) 
Second inspection fee: $25.
(4) 
Subsequent inspection fee after second inspection: $40.
B. 
Inspection fees will commence upon the applicant applying for a license under this article.
C. 
Duplicate licenses may be obtained for a fee of $5.
D. 
A late fee of $5 will be charged for those license renewal applications received after May 1.
The Board of Health of the Borough of Trainer may from time to time present to the Borough Council such suggested rules and regulations as it may deem necessary for the proper enforcement of the provisions of this article. Provided that such rules and regulations shall not be in conflict with the provisions of this article, Council may by ordinance approve and adopt said rules and regulations or any of them. Such rules and regulations so approved and adopted shall have the same force and effect as the provisions of this article, and the penalty for violation thereof shall be the same as the penalty for the violation of the provisions of this article, as hereinafter provided.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this article continues shall constitute a separate offense.
