The Pittsfield Municipal Airport Commission, created and established by Ordinance Number 259, approved on December 27, 1944, shall consist of seven members.

In accordance with Article 2, Section 2-10 and Article 3, Section 3-3 of the City Charter enacted by Chapter 72 of the Acts of 2003, the Mayor shall appoint all of the members to the Airport Commission as set forth in MGL c. 90, § 51E, and subject to city council approval, one of whom shall have experience in aeronautics. Each member shall serve a term of three years. In the event of a vacancy, the Mayor shall appoint a successor as soon as practicable, subject to city council approval, and said successor shall fulfill the unexpired term of the member whose seat was vacated.

The members of the municipal airport commission shall, in accordance with Article 10, Section 10-6(a) of the City Charter enacted by Chapter 72 of the Acts of 2013, serve without compensation and such commission shall choose its chairman and its secretary from among its members by a majority vote of its members.

The municipal airport commission shall have and exercise jurisdiction and control over the Pittsfield Municipal Airport, so-called, except as otherwise provided by statute, and shall be empowered to rent or lease the same or any part thereof in the name and behalf of the city and to collect the income or proceeds arising out of such rental, leasing or other use of such airport or any part thereof; meaning thereby the whole or any part of the premises that have been acquired by the city for the purpose of the establishment, maintenance and operation of a public airport, or may hereafter be acquired for such purpose, within the boundaries of the city. Such jurisdiction and control shall be complete except as otherwise provided by statute, but shall be subject to the provisions as to the adoption of airport approach regulations by the city council under sections 40A and following of chapter 90 of the General Laws. Such commission, however, shall not be empowered to make any expenditures nor to incur any expenses whatsoever regarding or concerning such airport until authorized to do so by order of the mayor and city council.

The municipal airport commission shall serve as the administrative agency under section 40E of chapter 90 of the General Laws if the city council shall adopt airport approach regulations under sections 40A and following of chapter 90 of the General Laws.

Subject to the provisions set forth in this article as to the matter of expenditures and expenses, the municipal airport commission may name employees as it deems necessary or proper, including an airport manager, assistant airport manager and weather observers.
