A certain document, copies of which are on file in the office of the Secretary of the Borough of Trainer, being marked and designated as the International Property Maintenance Code, 2012 Edition, as published by the International Code Council, shall be and is hereby adopted as the Property Maintenance Code of the Borough of Trainer for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as therein provided; providing for the issuance of permits and the collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Secretary of the Borough of Trainer are hereby referred to, adopted and made a part hereof as if fully set forth in this article, with the additions, insertions, deletions, amendments and changes prescribed in §
196-24 of this article.

The following sections of the International Property Maintenance
Code, 2012 Edition, are hereby revised and/or amended as follows:
A. Section 101.1. Insert "Borough of Trainer" for the name of the jurisdiction.
B. Section 103.2 is hereby revised to read as follows:

103.2 Appointment. The Code Official shall be appointed
by Borough Council. The Code Official shall serve at the pleasure
of Borough Council and may be removed at any time and for any reason
or for no specific reason.

C. Section 103.5. Insert the following as the appropriate schedule of
fees for activities and services performed by the Department of Property
Maintenance Inspection:

Wherever and whenever applicable, the fees applicable to certificate
of occupancy inspections and/or building, electrical, and plumbing
permits and inspections shall be applicable under the Property Maintenance
Code.

B.

Whenever an inspection is required under the Property Maintenance
Code, and when the inspection is not related to a certificate of occupancy
application or a building, plumbing or electrical permit application,
the following schedule of fees shall be applicable:

a.

Initial inspection: no charge.
|
|
|
b.
|
Follow-up inspection(s) relative to conditions observed at the
initial inspection: $100 per inspection.
|
D. Section 106.4 Violation penalties. Section 106.4 is
hereby revised and amended to read as follows: Any person, partnership,
corporation or other entity who shall violate a provision of this
code, or fail to comply herewith, or with any of the requirements
thereof, shall pay a fine of not more than $1,000 and/or be sentenced
to imprisonment for a term not to exceed 30 days. Each day that a
violation continues to exist shall constitute a separate offense.
E. Section 112.4 Failure to Comply. Insert "a fine of not
less than $500 nor more than $1,000 and/or be sentenced to imprisonment
for a term not to exceed 30 days. Each day that a violation of this
article continues to exist shall constitute a separate offense."
F. Section 304.14. Insert "May 1 through October 31" as the applicable
period of time.
G. Section 602.3. Insert "October 1 to May 30" as the applicable dates.
H. Section 602.4. Insert "October 1 to May 30" as the applicable dates.
All ordinances or parts of ordinances inconsistent herewith
are hereby repealed.
Nothing in this article or in the Property Maintenance Code
hereby adopted shall be construed to affect any suit or proceeding
pending in any court or any rights acquired or liability incurred
or any cause or causes of action acquired or existing under any act
or ordinance hereby repealed; nor shall any just or legal right or
remedy of any character be lost, impaired or affected by this article.
