It shall be unlawful and it is hereby prohibited for any person,
persons, firm or corporation to store, sell, offer or expose for sale
or have in possession with intent to sell or to use, discharge or
cause to be discharged, ignited, fired or otherwise set in action
within the limits of the Borough of Colwyn any fireworks, firecrackers,
rockets, sparklers, torpedoes, Roman candles, fire balloons or other
fireworks or substances of any combination whatsoever designed or
intended for pyrotechnic display, except after having obtained a license
as hereafter provided.
It shall be unlawful and it is hereby prohibited for any person,
persons, firm or corporation unnecessarily to discharge in or into
any street, highway or public place in the Borough of Colwyn any rifle,
gun, pistol, revolver, cane, cannon or other appliance, whether projecting
or exploding any bullet, cartridge, blank cartridge, cap or otherwise,
or any explosive substance or mixture of chlorates or nitrates.
Licenses for the public display of fireworks by properly qualified
individuals or corporations, or by the Borough officials, under the
direct supervision of experts in the handling of fireworks may be
issued by the Police Committee of the Council and Mayor in such form
as may be prescribed by such Committee upon furnishing such information
as such Committee may require if, in the opinion of such Committee
after proper inspection, such display shall not be hazardous to property
or endanger any person or persons, provided that application for such
licenses shall be made 15 days in advance of the date of display.
Such fireworks or devices for pyrotechnic display may be stored
within the limits of the Borough of Colwyn when the license for such
storage has been issued by the Police Committee and Mayor of the Borough
of Colwyn, provided that the building or premises in or upon which
such storage is to be made has been properly inspected by the Police
Committee and certified as a proper place for such storage, provided
that no license shall be issued for such storage within 100 feet of
a school, hospital, church or other public institution or any building
used as a place of public assembly.
The provisions of this chapter shall not apply to articles of
the kind and nature herein mentioned which shall be in the possession
of railroads or transportation companies for the purpose of transportation,
unless the same shall be held voluntarily by such railroad or companies
as warehousemen, provided that none of the provisions of this chapter
shall apply to signaling devices used by the railroad companies or
to high explosives used for blasting or similar purpose.

Any person who shall violate any of the provisions of this chapter
shall, upon conviction thereof, be subject to a fine of not more than
$1,000 and costs of prosecution and, in default of payment thereof,
to imprisonment for not more than 30 days.
The Police Committee, with the approval of the Mayor, shall
seize, take, remove or cause to be removed, at the expense of the
owner, all stocks of fireworks or combustibles offered or exposed
for sale, stored or held in violation of this chapter.

It shall be unlawful and it is hereby prohibited for any person,
persons, firms or corporations to store, sell, offer or expose for
sale at retail or to have in their possession with intent to sell
at retail or with intent to use or to discharge within the limits
of the Borough of Colwyn any air gun, air pistol, spring gun or any
implement not a firearm which impels with force a pellet of any kind.
"At retail" shall mean any sale of less than one dozen such articles,
or any sale to anyone not a bona fide dealer therein.

Any police officer of the Borough is hereby authorized to seize,
remove and destroy any air gun, air pistol, spring gun or any implement
not a firearm which impels with force a pellet of any kind which shall
be used or discharged within the Borough of Colwyn or which shall
be held and possessed in violation of this chapter.

The provisions of this chapter shall be severable, and if any
of the provisions hereof shall be invalid or unenforceable, the remaining
provisions of this chapter shall remain in effect.

All ordinances or parts of ordinances conflicting with any of
the provisions of this chapter are hereby repealed insofar as the
same affects this chapter.

This chapter shall become effective immediately.
