Hereafter, when anyone desires to install a standpipe, tank,
pump or measuring device or pipe in connection therewith for use in
the sale or distribution of gasoline or oils, the same shall not be
installed until a permit is first issued by the Borough Council. The
cost of said permit shall be $100.
All applications for such permits shall set forth the character
and capacity of said tank or tanks and the character and number of
said standpipes, pumps, measuring devices and pipes in connection
therewith and the intended place of location.
While standpipes may be located near the curbline with the approval
of the Borough Council, no pumps or measuring devices shall be placed
between the curbline and the building line, and all pumps and measuring
devices must be on the property of the applicant within the building
line. Tanks and necessary connecting pipes may be buried beneath the
sidewalk, but if so placed the sidewalk must be immediately restored
to its proper condition at the expense of the applicant.
All portable tanks or pumps must be kept on the property of
the applicant within the building line, except when in actual use.
The installation of standpipes, tanks, pumps and measuring devices
and pipes in connection therewith under a permit issued by the Borough
Council shall be done under the supervision of and subject to the
approval of the Highway Committee of the Council, and the use of portable
tanks or pumps as above specified shall be under the supervision of
the Highway Committee of the Council.

Any person violating the conditions of this article shall be
required to remove any pipes, measuring devices, tanks or pumps in
accordance herewith and shall pay a penalty of not more than $600
for each offense, and, in default of payment thereof, shall be imprisoned
in the Delaware County Prison for a period not exceeding 30 days.
