A. 
A structure used or intended for use for residential purposes by not more than two households shall have a smoke-sensitive alarm device on each level of the structure and outside each separate sleeping area in the immediate vicinity of the bedrooms and located on or near the ceiling in accordance with the National Fire Protection Association Standard No. 74-1984 for installation, maintenance and use of household warning equipment. The installation of battery-operated smoke-sensitive alarm devices shall be accepted as meeting the requirements of this section. The smoke-sensitive device shall be tested and listed by a product certification agency recognized by the New Jersey Bureau of Fire Safety.
B. 
Each structure, other than a seasonal rental unit, shall also be equipped with at least one portable fire extinguisher in conformance with rules and regulations promulgated by the Commissioner of Community Affairs pursuant to the Administrative Procedure Act, P.L. 1968, c. 410 (N.J.S.A. 52:14B-1 et seq.). For the purpose of this subsection, "portable fire extinguisher" and "seasonal rental unit" shall be defined as provided in N.J.S.A. 52:27D-198.1.
In the case where a change of use inspection or a certificate of occupancy inspection is regulated by another ordinance or regulation, this article shall not apply.

No structure sold for use for residential purposes by not more than two households shall be occupied without a certification of inspection for compliance with this article. The application fee as set forth in Chapter 150, Fees, Article I, Fee Schedule, § 150-28D, is nonrefundable, and the inspection must be scheduled within 60 days of the date of the application.
This article shall be enforced by the Municipal Compliance Officer or his designee.

Failure to comply with this article shall result in a penalty of not more than $500 in the case of a violation for an alarm device or a fine of not more than $100 in the case of a violation for a portable fire extinguisher.
This inspection shall be good for a period of 60 days. Failure to occupy the residence within this period will necessitate a reinspection and the repayment of the inspection fee in accordance with the Borough Fee Schedule.
