Hereafter, each and every person, firm or corporation owning
any lot or any part thereof on any of the streets in the Borough of
Muncy shall be required to pave the sidewalk, abutting on such lot,
or any part thereof, with concrete, according to the specifications
adopted from time to time by the Borough Council, and thereafter to
keep the same in good repair and safe condition. Provided: all newly
constructed sidewalks shall be made of concrete, by existing sidewalks,
lawfully constructed of brick or flagstone, and be repaired or reconstructed
of the same material, at the option of the property owner, in strict
conformity with standards established and prescribed by the Borough
Council. Provided further: Amiesite may be used in repairing and reconstructing
sidewalks if prior approval is obtained from the Borough Council,
and such use shall be in strict accordance with specifications established
by the Council.
A. No sidewalk shall be installed or constructed until a permit for
the same shall have been obtained from the Borough Council. At the
time of issuance of such permit, the grade of such sidewalk shall
be given by the Borough, and the construction of the sidewalk shall
conform to such grade.
B. Sidewalks hereafter constructed shall be paved to the following widths:
(1) On Main Street, from Pepper Street on the west and New Street on
the east to the South Borough line, four feet; from Pepper Street
on the west and New Street on the east to Penn Street, no less than
six feet; from Penn Street to Brady Street, no less than eight feet;
from Brady Street to the north Borough line, four feet.
(2) On Market Street, from Pepper Street to the south Borough line, four
feet; from Pepper Street to Water Street, five feet; from Water Street
to the north Borough line, four feet.
(3) On all other streets in the Borough, sidewalks shall be four feet
in width.
(4) Provided: Council may, in its direction, on application of the abutting
property owner, authorize a variance in width from the above requirements,
in any case where, because of natural conditions or otherwise, it
would be impracticable or would cause hardship to conform to the above
specified width.
C. Sidewalks must be kept free of weeds.
D. Adjacent blocks exceeding one-inch difference in height at any point
must be corrected to eliminate all differences in height.
E. Entrapment of water, after a rainstorm has ceased, must be corrected
to eliminate the standing water.
F. Property with three or more blocks having 40% or more of their surfaces
spalled, thereby creating an uneven surface, must be replaced.
G. Properties with sidewalks having four or more blocks, each cracked
into four or more pieces, must have the blocks replaced.
H. Whenever a sidewalk block, adjacent to a street intersection or curb,
must be replaced, the new block and adjacent curb, if there be one,
must be sloped down to within one inch of the street. Similarly, replacement
blocks at driveways having a step-down will be sloped to the driveway
to eliminate the step-down.
It shall be permissible to construct and maintain a driveway,
crossing a sidewalk, to gain access to abutting premises, only if
the grade of the sidewalk is maintained at the fixed level, without
any elevations or depression.
All work of construction, reconstruction or repair, as the case
may be, of any sidewalk, shall be completed, in strict conformity
with the requirements of this article and specifications adopted by
authority thereof, within 30 days after notice by the Borough authorities
to the owner of the abutting property. Upon the refusal or neglect
of any property owner to comply with any of the requirements of this
article after due notice, the work may be done by the Borough at the
expense of the owner or owners of the abutting property. Such expense
shall be collected by the Borough, as provided by the applicable Acts
of Assembly, with an additional amount of 10%.

A written request from the Borough Council to each and every person, firm or corporation owning property in the Borough of Muncy abutting a public thoroughfare whereon amesite is located in the sidewalk area to paint lines thereon for purposes of defining the public sidewalk area shall be deemed to be a repair for purposes of this article and included within the meaning of a repair under §§
236-1 and
236-3 of this article.
