The following regulations governing the use
of parks and playgrounds within the borough are hereby adopted and
are to be observed when within the limits of any park or playground
within the borough:
A. No person shall sell, use, possess or transport any
intoxicating liquor.
B. No person shall indulge in any threatening, abusive,
insulting or indecent language or commit any obscene, indecent or
disorderly act or commit any nuisance.
C. Animals are to be leashed at all times. All animal
excrement is to be immediately picked up and properly disposed of
by the owner or possessor of the animal.
D. No person shall possess any firearms, knives, air
guns, BB guns, slingshots, bows and arrows or other weapons.
E. No person shall operate or park any motorized vehicle
of any kind, including motorcycles or minibikes.
F. No person shall be in the parks or playgrounds after
8:00 p.m. unless at an approved, scheduled special event.

A. Specifically prohibited uses. The Borough of Upland, in the interest
of clearly defining prohibited uses of any park or recreation areas
located within the Borough, confirms that the following uses are specifically
prohibited in any park or recreation area and all other areas of the
Borough of Upland, except when such uses are formally authorized and/or
sponsored by the Borough of Upland through a formal vote by said Upland
Borough Council at a scheduled meeting:
(1) Carnivals, fairs, circuses or events of similar nature. For the purposes
of this chapter, a fair includes the assembly of amusement rides,
games or other attractions.
(2) The display of animals customarily displayed in zoos.
(6) Any occupation of any park or recreation area(s) after 11:00 p.m.,
except for overnight camping by Boy Scouts, Girl Scouts or other recognized
youth organizations, provided that there is:
(a)
Adequate adult supervision.
(b)
Adequate provisions for health, sanitation, security and safety.
(c)
No noise or disturbance which can be heard outside the boundaries
of the said park or recreation area between the hours of 9:00 p.m.
and 7:00 a.m.
(d)
A special event permit issued by the appropriate Borough of
Upland authority for the said camping event.
(e)
No continuous occupation of more than three days.
(g)
A written plan, presented by the sponsoring organization, that
outlines the parking of any accessory cars, trucks, trailers, mobile
homes, campers, motor homes or other similar mobile sleeping facilities.
Such plan shall have been reviewed and approved by the Upland Borough
Manager and the Upland Borough Police Chief at least five days prior
to the beginning of the camping event.
(h)
An understanding that the sponsoring organization is completely
responsible for the lawful behavior of all participants during the
camping event.
B. Ball playing.
(1) Upland Borough Council desires to eliminate or reduce any risk of
property damage or injury which can occur as a result of activities
that may take place within the parks of the Borough.
(2) As used in this section, the term "ball playing" shall be intended
to include activities that are normally associated with practicing
or playing the team-oriented sports of baseball and softball, where
a bat and a ball are used. This section is not intended to limit activities
of small children playing with Wiffle® Balls, kickballs, large
"bouncy balls" and the like.
(3) There is no ball playing permitted within the boundaries of the following
parks and/or playgrounds in the Borough of Upland.
(c)
Crozer Memorial Playground.
(4) Ball playing is permitted on Bristol Lord Field in designated areas
and subject to the rules and regulations prescribed by the Upland
Borough Council or its designee.
The Borough Manager and/or borough police officers
shall enforce this chapter.
Whoever violates any provision or regulation
set forth in this chapter shall, upon conviction in a summary provision,
be fined not more than $600 and costs and, in default of payment thereof,
shall be imprisoned not more than 90 days.
