No person shall use Memorial Field Stadium, press booth or the picnic areas at Memorial Field, Brush Park or Hutchinson Field without first obtaining a permit therefor from the Commissioner of Recreation. The provisions of this article shall not apply to activities sponsored by the City of Mount Vernon.

A. 
No permit shall be issued by the Commissioner of Recreation for the use of Memorial Field Stadium or the picnic areas at Brush Park, Hutchinson Field or Memorial Field until the applicant shall have first agreed to indemnify and hold the City of Mount Vernon harmless from any and all claims arising from the applicant's use of the aforesaid stadium and picnic areas, and the applicant shall agree to compensate the City for any damage done by reason of the applicant's use of the aforesaid stadium and areas.
B. 
No permit for use of the stadium and picnic areas shall be issued, except as hereinafter provided, until the applicant shall have first placed on file with the Commissioner of Recreation a public liability insurance policy, indicating combined single limit bodily injury and property damage coverage in the amount of $1,000,000 for each occurrence, said coverage including the City of Mount Vernon as an additional named insured.

B. 
Press booth. The Commissioner of Recreation shall charge the following additional fees for the use of the press booth at Memorial Field Stadium:

(1) 
The Mount Vernon Board of Education shall be charged $60.
(2) 
Any other person or group shall be charged $125.

C. 
Picnic areas at Memorial Field, Brush Park and Hutchinson Field.
(1) 
The following fees shall be charged by the Commissioner of Recreation for use of the aforesaid picnic areas in accordance with the following:

D. 
Special rentals. The Commissioner of Recreation may set special rental fees subject to the approval of the City Council, based on the following factors:

Size of activity.
(2) 
Duration of activity.
(3) 
Organization sponsoring activity, such as charitable, not-for-profit, religious, governmental.
(4) 
Entrance fees, charged by permit holder for such activity.
E. 
Special rentals with promoters.

(1) 
The Commissioner of Recreation may set special rental fees for special events with promoters subject to the approval of the City Council based on the following factors:
(a) 
Size of activity.
(b) 
Duration of activity.
(c) 
Organization sponsoring activity, such as charitable, not-for-profit, religious, governmental.
(d) 
Entrance fees charged by permit holder for such activity.
(2) 
All promoters will be assessed a nonrefundable application processing fee of $50, which shall cover the cost of:
(a) 
Reference checks of promoters.
(b) 
Sponsorship guaranty.
(c) 
Confirmation of artist commitment.
(d) 
Organization of the proposed event with the Department of Public Safety regarding manpower and salaries.
(3) 
For any event in which the crowd capacity exceeds 1,500, promoters shall be assessed a special rate to be determined by the Commissioner of Recreation.

F. 
Parking lots at Memorial Field, Brush Park and Hutchinson Field.

(1) 
The Commissioner of Recreation may issue permits for the use of parking spaces in the parking lots at the aforesaid municipal fields.
(2) 
The Commissioner of Recreation shall charge $16 per month for each parking space.
(3) 
Permits are not transferable.
(4) 
Permittees shall use only the parking spaces designated by the Commissioner of Recreation for permit parking and shall use such parking spaces at their own risk.

Tennis courts under the jurisdiction of the Recreation Department are available for legal residents of the City of Mount Vernon or owners of property within the City of Mount Vernon and nonresidents, subject to the conditions herein.

B. 
All players must purchase a season permit in person and register with the Department of Recreation, Room 3, Municipal Building, Mount Vernon.
C. 
Residents and City property owners. Adult permits (18 years of age or older) are $55. Senior citizen permits (60 years of age or older) are $35. Youth permits (under 18 years of age) are $35. Family permits are $85 (includes mother, father and all children under 18 years of age). Permits for the disabled are $20. Permits are good for the calendar year issued and do not include the tennis bubble at Memorial Field.

F. 
Before using the tennis courts, all players shall first register with the attendant on duty by displaying a valid permit and providing name, address and proper identification.
G. 
Players not holding a valid season permit may play only as the guest of a valid permit holder. Guests shall not play without at least one valid permit holder on the court. All guest fees shall be paid before players are admitted to courts. Guest fees shall be as follows: $10 per guest.

H. 
Attendants have been instructed to provide receipts for all fees paid. Please take and keep your receipt.
I. 
Telephone reservations will be accepted two days in advance. Names, addresses and permit numbers must be given when reservations are made.

J. 
Reservations will be held only until 10 minutes after the hour scheduled. In case those who have reserved the court are not present on the exact hour scheduled, others waiting for courts will be tentatively allowed to play until 10 minutes past the hour; then if the scheduled players have not arrived, the tentative players shall pay for the court and have the use of it for the balance of the hour.
K. 
A reservation may not be canceled later than one hour before the scheduled hour on weekdays and three hours on Saturdays, Sundays and holidays. Those failing to cancel reservations in accordance with the foregoing shall thereafter be denied the privilege of making reservations.
L. 
Reservations shall be made for one hour only. If, however, at the close of one hour of play a court is open, it may be booked by those who have already played.
M. 
There shall be no tennis lessons on Saturdays, Sundays and holidays.
N. 
There shall be no tennis lessons after 6:00 p.m. on weekdays.
O. 
Proper tennis attire must be worn at all times. Only those wearing smooth, rubber-soled shoes without heels will be allowed to play on the courts.
P. 
Tournaments and leagues. The Commissioner of Recreation shall charge the following fees for use of the tennis courts.

Q.

The Commissioner of Recreation shall have the right to regulate the use of the field on all matters not covered by these rules and regulations.

A. 
It shall be unlawful to loiter or to remain in Memorial Field between the hours of 10:00 p.m. and 6:00 a.m. without the prior special permission of the Commissioner of Recreation.
B. 
The Commissioner of Recreation is hereby authorized and directed to install at each entranceway a chain or gate which may be secured during the hours Memorial Field shall be closed and post at each said entranceway a sign stating clearly and legibly: FIELD CLOSED — 10:00 p.m. — 6:00 a.m.
