It shall be unlawful for any circus, carnival, street fair,
medicine show, or any other outdoor exhibition, operated for profits,
to operate such circus, carnival, street fair, medicine show or exhibition,
in the Township of Elizabeth, without first having secured a permit
therefore as hereinafter provided, and paid the permit fee for said
exhibition in accordance with the schedule of fees in the following
section of this Part.

Permit or license fees shall be charged by, and paid to, the
Township before any permit or license shall be issued for any such
exhibition. Such fees shall be established by resolution of the Board
of Commissioners.

1. The President of the Board of Township Commissioners or any one acting
in his capacity, shall issue said permits or license and the same
shall be attested by the Secretary of said Board, but the President
or anyone acting in his capacity, shall have full power and authority
to refuse to anyone a permit or license to operate such circus, carnival
or other exhibitions.
2. Each permit or license shall specify the name of the person, firm,
corporation or partnership operating said exhibition, the number of
tents in said exhibition, the number of days and dates to be exhibited,
the rates paid per day and the total amount paid for said permits
or license.

It shall be unlawful to operate in said Township any such circus,
carnival, street fair, medicine show or any other exhibition which
shall use or permit to be used any gambling device or devices or game
of change, or shall exhibit or permit to be exhibited any performance
or act or exhibition that is indecent or immoral in appearance or
in character, under penalty of instant revocation of said permit or
license forfeiture of the permit fee paid, and of the provisions of
§ 305 of this Part or hereinafter more fully set forth.

Any person, firm or corporation who shall violate any provision
of this Part 3 shall, upon conviction thereof, be sentenced to pay
a fine of not more than $1,000.00; and/or to imprisonment for a term
not to exceed 90 days.
