A. Any person who knowingly violates any requirement of this chapter
or of any wastewater discharge permit condition or limitation implementing
the requirements of this chapter shall be guilty of a misdemeanor
and upon conviction thereof shall, if the person is not a corporation,
be punished by a fine not exceeding $20,000 per day of violation or
by imprisonment for a term of not more than one year, or by both such
fine and imprisonment; and if the person is a corporation shall, upon
conviction, be punished by a fine not exceeding $40,000 per day of
violation.
B. Any person who knowingly makes any false material statement, representation
or certification in any application, record, report, plan or other
document filed or required to be maintained under this chapter or
who knowingly falsifies, tampers with or renders inaccurate any monitoring
device or method required to be maintained under this chapter, shall
be guilty of a misdemeanor and, upon conviction thereof, shall, if
the person is not a corporation, be punished by a fine not exceeding
$20,000 per day of violation or by imprisonment for a term of not
more than one year, or by both such fine and imprisonment; and if
the person is a corporation shall, upon conviction, be punished by
a fine not exceeding $40,000 per day of violation.
