This Zoning Code is designed to provide and to implement a Comprehensive
Plan of Land Use and Population Density for the Town of Orangetown.
This code and said plan are designed to further the purposes set forth
in Article 16 of Chapter 62 of the Consolidated Laws of the State
of New York, and for the protection and promotion of the public health,
safety, morals, comfort, convenience, prosperity and other aspects
of general welfare, particularly of the Town, in the following ways:
1. To guide the future development of the Town in accordance with a
Comprehensive Plan of Land Use and Population Density, so that the
Town may realize its potentialities as a place to live and to work,
with the most beneficial and convenient relationships among the residential,
commercial and industrial areas within the Town, and with due consideration
to the peculiar suitability of each of these areas or various uses
and to existing conditions and trends in population, economic activity,
land use and building development.
2. To encourage an orderly pattern of residential development around
existing communities in the Town in order to facilitate the adequate
provisions of schools and other public services on an economical basis
and to avoid the disorderly and blighting pattern of development and
the unnecessarily high costs of public services resulting from scattered
developments unrelated to each other.
3. To provide suitable area for desirable commercial and industrial
development along major transportation facilities within the Town
and to reserve the best industrial land for industrial use in order
to promote the growth of employment conveniently located for residents
of the Town and to facilitate the adequate provision of public services
on an economical basis.
4. To bring about the gradual conformity of the uses of buildings and
land throughout the Town to this Comprehensive Plan for the Town's
development.
5. To help bring about the most beneficial relation between the uses
of buildings and land and the circulation of traffic through and within
the Town, with particular emphasis on providing adequate, safe and
convenient access for traffic to the various uses of buildings and
land throughout the Town and on avoiding traffic congestion in the
streets and highways in the Town.
6. To protect and conserve the value of land and the value of buildings
appropriate to the various districts established by this code.
The Town Board of the Town of Orangetown, in Rockland County,
New York, hereby adopts and enacts this code as the Zoning Code of
the Town of Orangetown. This code shall be known and may be cited
as the "Zoning Code of the Town of Orangetown."
A "commercial street" is any street which is adjacent to and
abuts a zoning district which is nonresidential. A "residential street"
is any other street in the Town of Orangetown. No entrance to property
zoned nonresidential is permitted through property zoned for residential
uses.
For the purpose of providing for the development of a system
of major streets and highways in the Town and for future improvement,
reconstruction and necessary widening of streets and highways, each
street in the Town is hereby designated by one of the following street
classifications: major street, secondary street, collector street
and local street. The classification of each street is based on its
present and estimated future traffic volume and its relative importance
and function in the system of major streets and highways. The required
front yard and maximum building height for any lot shall be measured
as set forth for each street classification in § 5.111.
The street classification for this purpose of each street or highway
or portion thereof in the Town shall be as set forth on the Official
Map. Such map, together with everything shown thereon, is hereby made
a part of this code.
