A.
STREET NUMBER 1
STREET NUMBER 2
As used in this article, the following terms shall have
the meanings indicated:
The thoroughfare starting at Dutch Hill Road and going easterly
to Waldbaum's store.
The thoroughfare starting at Highview Avenue and going north
to its intersection with Street Number 1.
B.
All words, terms or phrases used herein shall have the
meanings as defined in the Vehicle and Traffic Law of the State of
New York; if no specific definition is set forth therein, all words
shall have their usual meaning in the English language.
No person shall operate a motor vehicle upon the streets listed in § 40-1, Definitions, above, at a rate of speed in excess of 30 miles per hour. This section shall not apply to ambulances, fire vehicles or police vehicles when on emergency trips.
No vehicle shall be parked on either street within the Orangeburg
Shopping Plaza other than parallel with the edge of the street, headed
in the direction of traffic, and with front and rear wheels not more
than six inches from the curb. Parallel parking to be allowed in lots
designated and marked for parking of vehicles.
Except when necessary to avoid conflict with other traffic,
or in compliance with law or the directions of a police officer or
official traffic-control device, no person shall, within the limits
of the Orangeburg Shopping Plaza:
A.
Stop, stand or park a vehicle.
(1)
On the roadway side of any vehicle stopped, standing or
parked at the edge of a street.
(2)
On a sidewalk.
(3)
Within an intersection, except when permitted by official
signs or parking meters on the side of a highway opposite a street
which intersects but does not cross such highway.
(4)
On a crosswalk.
(5)
Alongside or opposite any street excavation or obstruction
when stopping, standing or parking would obstruct traffic.
B.
Stand or park a vehicle whether occupied or not, except
momentarily to pick up or discharge a passenger or passengers.
(1)
Within 20 feet of a crosswalk at an intersection, unless
a different distance is indicated by official signs, markings or parking
meters.
(2)
Within 30 feet upon the approach to any flashing signal,
stop signal or traffic-control signal located at the side of the roadway,
unless a different distance is indicated by official signs, markings
or parking meters.
(3)
Within 20 feet of any intersection unless a different
distance is indicated by official signs, markings or parking meters.
C.
Stop, stand or park a vehicle within 15 feet of a fire
hydrant, except when such vehicle is attended by a licensed operator
or chauffeur who is seated in the front seat and who can immediately
move such vehicle in case of emergency, unless a different distance
is indicated by official signs, markings or parking meters.
D.
Move a vehicle not lawfully under his control into such
prohibited area or away from a curb such distance as is unlawful.
E.
Stop, stand or park in violation of the restrictions stated
on official signs when such signs have been posted prohibiting, restricting
or limiting the stopping, standing or parking of vehicles on any highway.
The following intersections are hereby designated as stop intersections
and all vehicles approaching said intersections as hereinafter set
forth shall, before entering the intersection, come to a full stop,
unless otherwise directed by a peace officer or signal:
There shall be no parking at any time on the north and south
sides of Street Number 1, on the west side of Street Number 2 from
the intersection of Highview Avenue to the intersection of Street
Number 1, on the east side of Street Number 2 from the intersection
of Highview Avenue to the south side of the Orangeburg Theater. There
shall be no parking at any time except in the area designated as "pickup
zone" extending from the south end of the Orangeburg Theater to north
side of Waldbaum's store on Street Number 2.
Every vehicle shall be driven only upon the right-hand roadway
of Street Number 1 and Street Number 2, which has been divided into
two roadways by a double yellow line, and no vehicle shall be driven
over, across or within any such dividing space.
No deliveries may be made from Street Number 2 area. All deliveries
to markets within the Shopping Plaza shall be made in the rear of
the stores or from the north area of Waldbaum's store.
All laws, ordinances or regulations, or parts thereof, inconsistent
with this law are hereby repealed.

A.
Any person violating the provisions of § 40-2 herein shall be guilty of a traffic infraction, which said offense, upon conviction thereof, shall be punishable by a fine not to exceed $200 or by imprisonment not to exceed 15 days, or both such fine and imprisonment.
B.
Any person violating any of the provisions of this law
except as hereinbefore provided in Subdivision A of this section shall
be guilty of a traffic infraction, which said offense, upon conviction
thereof, shall be punishable by a fine not to exceed $50 or by imprisonment
of not more than five days, or both such fine and imprisonment.
If any section or provision of this law shall be adjudged invalid
or unconstitutional by a court of competent jurisdiction, such adjudication
shall not affect the validity of this law as a whole or any section,
provision or part thereof not adjudged invalid or unconstitutional.
This local law shall take effect immediately.

A.
METRO-NORTH COMMUTER PARKING FACILITY
As used in this article, the following terms shall have
the meanings indicated:
Hereinafter referred to as the "facility," is designated
as the property and premises owned by the Metropolitan Transportation
Authority and/or the Metro-North Commuter Railroad Company, located
at Railroad Place, between Jefferson Avenue and Franklin Avenue in
the Hamlet of Pearl River.
B.
All words, terms or phrases used herein shall have the
meanings as defined in the Vehicle and Traffic Law of the State of
New York (VTL); if no specific definition is set forth therein, all
words shall have their usual and customary meaning in the English
language.
No person shall operate a motor vehicle upon the facility at
a rate of speed in excess of 25 miles per hour. This section shall
not apply to ambulances, fire vehicles or police vehicles when on
emergency trips.
No vehicle shall be parked at the facility other than parallel
with the edge of the street, headed in the direction of traffic, and
with front and rear wheels not more than six inches from the curb.
Parallel parking shall be allowed only in lots designated and marked
for parking of vehicles.
Except when necessary to avoid conflict with other traffic,
or in compliance with law or the directions of a police officer or
official traffic control device, no person shall, within the limits
of the facility:
A.
Stop, stand or park a vehicle:
(1)
On the roadway side of any vehicle stopped, standing or
parked at the edge of a street.
(2)
On a sidewalk.
(3)
Within an intersection, except when permitted by official
signs or parking meters on the side of a highway opposite a street
which intersects but does not cross such highway.
(4)
On a crosswalk.
(5)
Alongside or opposite any street excavation or obstruction
when stopping, standing or parking would obstruct traffic.
(6)
In a parking spot officially designated, by a sign, pavement
marking or other official notice, as reserved or set apart for, or
assigned to, vehicles registered pursuant to § 404-a of
the Vehicle and Traffic Law of the State of New York (VTL § 404-a),
as same may be amended from time to time.
B.
Stand or park a vehicle, whether occupied or not, except
momentarily to pick up or discharge a passenger or passengers:
(1)
Within 20 feet of a crosswalk at an intersection, unless
a different distance is indicated by official signs, markings or parking
meters.
(2)
Within 30 feet upon the approach to any flashing signal,
stop signal or traffic control signal located at the side of the roadway,
unless a different distance is indicated by official signs, markings
or parking meters.
(3)
Within 20 feet of any intersection, unless a different
distance is indicated by official signs, markings or parking meters.
C.
Stop, stand or park a vehicle within 15 feet of a fire
hydrant, except when such vehicle is attended by a licensed operator
or chauffeur who is seated in the driver's seat and who can immediately
move such vehicle in case of emergency, unless a different distance
is indicated by official signs, markings or parking meters.
D.
Move a vehicle not lawfully under his control into any
prohibited area described herein, or away from a curb such distance
as is unlawful.
E.
Stop, stand or park in violation of the restrictions stated
on official posted signs and/or pavement markings.
All exits to the parking area within the facility are hereby
designated as stop intersections, and all vehicles approaching said
intersections as hereinafter set forth shall, before entering the
intersection, come to a full stop, unless otherwise directed by a
peace or police officer or traffic control device.
Any vehicle parked or abandoned in the facility during a snowstorm,
flood, fire or other public emergency in the facility may be removed
and stored by the Town of Orangetown, if the vehicle constitutes an
obstruction to traffic or if stopped, parked or standing in any prohibited
area described herein; and the owner or operator of any such vehicle
shall pay the Town the reasonable charges for such removal and storage.
All local laws, ordinances or regulations, or parts thereof, inconsistent with this article II are hereby repealed.
