The purpose of this Part 2 is to alleviate certain dangerous
conditions which exist from unused ore bins, unused or abandoned wells,
unused or abandoned industrial facilities which were constructed for
use beneath the surface of the land to which children and other passers-by
have access with or without the permission of the owner of such property.

Unguarded, unused ore bins, unused or abandoned wells, unused
or abandoned industrial facilities which were constructed for use
beneath the surface of the land to which children and other passers-by
have access are hereby declared to be dangerous conditions which this
Part is designed to alleviate.

The owner, tenant or person occupying any land upon which there
exists conditions and facilities such as are set forth in §§ 201
and 202 herein shall, within 60 days from the effective date of this
Part pump from and drain any water that has been permitted to accumulate
in any such area and shall cause said area to be filled-in, backfilled,
and leveled so as to conform to the contour of the area surrounding
said condition or facility.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a district justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000.00 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each Section of this Part which shall be found to have been violated
shall constitute a separate offense.
