This Part shall be known and may be cited as "The Smith Township Industrial Waste and Refuse Ordinance."

Unless otherwise expressly stated, the following words and phrases shall be construed throughout this Part to have the meanings as follows:
BOARD
the Board of Supervisors of Smith Township.
INDUSTRIAL WASTE
any discarded waste which is a by-product of any industrial plant which waste shall contain dangerous, offensive, and other qualities injurious to life, health, animal life or the soil and water.
PERSON
any partnership, association, firm and corporation.
TOWNSHIP
Smith Township, Washington County, Pennsylvania.

It is hereby ordained and enacted by the Board of Supervisors for the Township of Smith, Washington County Pennsylvania, that it shall be unlawful for any person or any agent thereof to dump, empty or place upon the ground or in any stream or any body of water, any acid, industrial waste, pickling acid, lime, or combination thereof, on any land or any wasted area, or [in any] streams of water within the said Township, unless authorized pursuant to the Zoning Chapter, and in addition to all State and Federal regulations.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000.00 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

In addition to the remedies provided in § 304 above, any continued violations of this Part which shall constitute a nuisance in fact or which shall in the opinion of the Board constitute a nuisance may be abated by proceeding against the violator in a court of equity for relief.
