The purpose of this ordinance is to regulate the use of mobile telephones while operating a motor vehicle in Plymouth Township. It is the position of Plymouth Township that the operation of a motor vehicle while using a mobile telephone can cause the operator to maintain less attention to the operation of a motor vehicle and the use of a mobile telephone has been a factor in many traffic accidents. Plymouth Township believes that the regulation of the use of a mobile telephone while operating a motor vehicle in Plymouth Township is necessary to protect the health, safety and welfare of persons operating motor vehicles, other drivers, passengers, pedestrians, and the general population of Plymouth Township.

As used in this ordinance, the following terms shall have the meanings indicated:
HANDS-FREE DEVICE
An external device that connects to a mobile telephone that allows the user to engage in the use of the mobile telephone without touching the user's mobile telephone.
MOBILE TELEPHONES
Includes, but is not limited to, cellular, analog, wireless and digital telephone.
USES
Operating a mobile telephone by either dialing, answering, talking, listening, messaging, emailing or texting.

(a) 
No person shall operate a motor vehicle on any street within Plymouth Township while engaging in any conduct defined as use of a mobile telephone unless the operator maintains both hands on the steering device of the motor vehicle.
(b) 
Subsection (a) of this section does not apply to a person who is using a mobile telephone:
(1) 
To call 911, contact police, fire or ambulance, to report a traffic accident or to report unsafe driving.
(2) 
While maintaining the vehicle in park position.
(3) 
With a hands-free device which allows the operator to maintain both hands on the steering device.

(a) 
This ordinance shall not apply to law enforcement officers and operators of emergency vehicles when on duty and acting in their official capacities.

The penalty for a violation of this ordinance shall be a fine of not less than $150 nor more than $300. A person who receives a notice of violation of this ordinance may, within 10 days of receipt of such notice, pay a reduced fine of $75.
