The following rules and regulations shall apply to all parks and recreation areas within the Borough of Essex Fells. The failure to follow these rules and regulations shall be a violation of this chapter.
A. 
Borough parks and recreation areas shall be open to the public between sunrise and sunset, and signs shall be posted designating the same. The penalty for a violation of this subsection shall be:

(1) 
First offense: $50.
(2) 
Second offense: $75.
(3) 
Third offense: $100.
(4) 
Fourth and subsequent offenses: $150.
B. 
A park and recreation area may be closed to the public, pursuant to rules hereinafter adopted, at certain times and intervals or shall be restricted to certain uses as found reasonably necessary.
C. 
The following acts shall be prohibited:
(1) 
Littering. The penalty for a violation of this subsection shall be:

(a) 
First offense: $50.
(b) 
Second offense: $75.
(c) 
Third offense: $100.
(d) 
Fourth and subsequent offenses: $150.
(2) 
Use of glass bottles.
(3) 
Parking vehicles on the grass.
(4) 
Consumption of alcoholic beverages.
(5) 
Unleashed dogs.
(6) 
Fires and/or barbecues, except in designated areas.
(7) 
Organized sports play, except in designated areas.
(8) 
Unauthorized sales or commercial activities.

Any person, firm or corporation who violates any of the provisions of this chapter shall, upon conviction, be punished as provided in Chapter 1, Article III, General Penalty, and each violation of any of the provisions of this chapter and each day the same is violated shall be deemed and taken to be a separate and distinct offense.
