The office of Village Administrator is hereby created subject
to the provisions of this article.

The President and Board of Trustees are hereby authorized to
employ a Village Administrator. The Administrator shall be appointed
by the President, by and with the advice and consent of the Board
of Trustees. The Village Administrator may also be referred to or
be known as the "Village Manager." Unless otherwise provided by contract,
the person appointed to this office shall establish residency within
the Village (which shall include the Village school districts and
the Village fire protection district) within one year after appointment.
Neither the President, nor any member of the Board of Trustees, shall
be appointed to serve as the Village Administrator within two years
after the expiration of his or her term of resignation from office.

The Village Administrator shall furnish a bond in such amount
and with such surety as may be approved by the corporate authorities,
such bond to be conditioned upon the faithful performance of his or
her duties. The cost of the bond shall be paid by the Village. The
bond of the Village Administrator may be part of a blanket bond.

The Village Administrator shall receive such compensation as
the corporate authorities shall, from time to time, establish. Upon
appointment and confirmation by the Village Board, the Village may
enter into an employment contract which specifies in writing the level
of compensation of the Administrator, fringe benefits, and any other
appropriate agreements describing the working relationship between
the Administrator and the corporate authorities. The contract shall
also set forth the Administrator's performance expectations and
job requirements. The Administrator's contract may exceed one
year, but may not exceed the term of the President holding office
at the time the contract is executed.

The Village Administrator, under and subject to the direction
of the Village President and enactments of the corporate authorities,
shall be the chief administrator of the Village, and shall be responsible
for the proper administration of the affairs of the Village.

The Village Administrator shall be responsible to the President
and Village Board for the proper administration of all affairs of
the Village. In discharging this responsibility, the Village Administrator
shall:
A. Direct, supervise, and coordinate the administration of all departments,
offices, and agencies of the Village, except as otherwise provided
by law;
B. Recruit, screen and evaluate all candidates for employment with the
Village; recommend the appointment, suspension or removal of any Village
employee or appointed administrative officer. When necessary for the
good of the Village, the Village Administrator may suspend or remove
a Village employee, without pay, for a period not to exceed 14 days
except when otherwise provided for by law. The Village Board may,
by majority vote, reinstate such employee and award retroactive pay.
All appointments and removals shall be based solely upon merit and
on the qualifications or disqualifications of the individuals involved,
without regard to race, sex, religious convictions, or political belief
or affiliation;
C. Attend all Village Board meetings. The Village Administrator shall
have the right to take part in all discussions, but shall not vote;
D. Provide for the enforcement of all laws and ordinances within the
Village;
E. In cooperation with the Village Clerk, the Village Treasurer and
the Chairperson of the Committee on Finance and Administration, provide
the necessary information concerning estimated funds to be available
to the Village and necessary costs to be defrayed by the Village for
each fiscal year, and present such matters to the Village Board prior
to the preparation of the annual budget ordinance; and after discussion
thereof, in cooperation with the Village Clerk, Treasurer and Chairperson
of the Committee on Finance and Administration, prepare a summation
of the estimated funds and expenses of the Village for the next fiscal
year for the preparation of the annual budget ordinance;

F. Prepare the budget annually, with the advice of the Budget Committee,
and submit it to the Village Board not later than the first meeting
of the Village Board in March of each year, together with a description
of any important features and responsibilities for its administration
or adoption;
G. Keep the Village Board fully advised as to the present financial
condition and future needs of the Village;
H. Advise the Village Board on pending decisions of public policy and
recommend to the Board the adoption of such measures as the Administrator
may deem necessary or expedient for the health, safety, or welfare
of the community or for the improvement of administrative services;
I. Be responsible for procurement of commodities and services for all
Village departments, offices, and agencies, and promulgate purchasing
rules which shall be followed by employees in the procurement of goods
and services;
J. Propose to the Village Board such personnel rules and regulations
as the Administrator deems necessary to manage the personnel policies
of the Village and recommend to the Village Board salaries of all
officers and employees of the Village on an annual basis;
K. With the assistance of the Village Attorney, be responsible for the
conduct of all collective bargaining processes of the Village and
recommend to the Village Board collective bargaining agreements for
consideration and possible final approval by the Board. The Village
Administrator shall be responsible for administering all employee
organization contracts reached through the collective bargaining process;
L. Provide staff support services for the President and members of the
Village Board;
M. Research and review funds that may be available to the Village through
federal, state, or private agencies and bring such matters to the
attention of the Village Board;
N. Make in the ordinary course of business any and all purchases of
materials and supplies reasonably necessary for the day-to-day operation
of the Village, as generally provided for in the annual budget ordinance,
provided that any purchases in excess of $3,000 shall not be made
until after first procuring the approval of the Village Board, and
included therewith, in any purchase, complying with applicable statutes
and ordinance providing for, among other things, the solicitation
and publication for bids, and actively seek the lowest and best price
for the Village considering service, quality, availability and price;

O. Make reports and to anticipate future needs of the Village, either
because of growth, deterioration of existing facilities, or modern
techniques, and work with the Village Planning Commission and the
Village Zoning Board of Appeals with respect to the desired growth
and expansion of the Village;
P. Investigate all complaints in relation to matters concerning the
administration of the Village government, and make a report of the
same to the Village Board;
Q. Keep a correct and accurate list of all equipment, property, and
supplies owned and operated by the Village, and charge the head of
each department with the duty to file a correct and accurate list
of the machinery, property, and supplies under the control of such
department head, and cause the department head to be responsible for
such equipment and make an accounting of such equipment, supplies,
and property upon the removal or resignation of such department head,
and provide the Board of Trustees with an annual report of all such
property, equipment, and supplies; and provide for the orderly replacement
of machinery, equipment, and supplies as may from time to time be
necessary;
R. Evaluate personnel and present those evaluations to the Village Board
at least annually. One written evaluation for each employee shall
be presented to the Village Board one month preceding the meeting
in which compensation is to be determined or at such other time or
times as the Board may deem appropriate. The Administrator's
evaluations of personnel shall be developed with the respective department
heads. Evaluation of department heads is the responsibility of the
Village Administrator, and any committee chairmen;
S. When the Village Board has made a decision to consider expending
funds and bidding is required or is deemed to be in the best interests
of the Village, the Administrator, in consultation with the department
heads and the pertinent Village Board committee, shall develop specifications,
solicit bids, receive and review bids, and make a recommendation for
acceptance by the Village Board. This process does not preclude the
assistance by professionals. The employment of such professional assistance
must be approved by the Board;
T. The Village Administrator should recommend that the Village invest
surplus monies at such times and in such amounts as the Administrator
sees fit, in accordance with state laws and policies of the Village
Board. The Administrator shall see that appropriate records of investments
are maintained and report monthly all investment activities to the
Board;
U. Oversee the day-to-day operation of the municipality while promoting
a cooperative atmosphere between and among all employees;
V. Provide leadership in the formulation of short-range and long-range
plans. Annually, he shall present to the Village Board a "State of
the Village" report in which the future plans for the Village are
expressed;
W. Be ever mindful of the necessity for positive public relations and
shall be continually engaged in a program of presenting the best image
of the Village. It shall be the duty of the Village Administrator
to create and maintain a cooperative working relationship with other
governmental bodies and community organizations, including those involving
economic development;
X. Fulfill his duties and responsibilities as Village Administrator
on a full-time basis and not assume outside responsibilities involving
remuneration and/or time away from his job without the expressed consent
of the Village Board;
Y. Make such other reports and perform such other duties as may be specified
by law or Village ordinance or as may from time to time be assigned
by the Village Board.

The Village President may remove the Administrator in the same
manner as the removal of other appointed officers and in accordance
with the law.

If, because of a temporary absence, disability, or illness,
the Village Administrator is unable to carry out the functions of
this office, the President and Village Board may appoint a member
of the Village's senior administrative staff to serve as Acting
Administrator and carry out the duties of the Administrator during
the Administrator's absence.

All offices and departments shall submit all matters requiring
Board of Trustees' action or attention to the Village Administrator,
who shall submit them to the Village President and Board with recommendations
as may be deemed necessary. All departmental or employee requests
shall be submitted to the Village Administrator and such requests
as to departmental operations shall be addressed by the Village Administrator.
The establishment of Village policy shall be derived from the directions
of the Village President and the enactments of the Village Board.
No Village Board member shall give directions or orders to any Village
employee except in the absence of the Village Administrator during
emergencies.
Nothing in this article shall be deemed to diminish or detract
from the statutory powers and authority of the Village's elected
officials.
