No water from the Village water supply shall be turned on for service into any premises by anyone but the Public Works Director or some other person authorized by him or her to perform this service.
Application to have water turned on shall be made in writing to the Village Clerk, and shall contain an agreement by the applicant to abide by and accept all of the provisions of this chapter as conditions governing the use of the Village water supply by the applicant.

A deposit shall be made with each such application, this sum to be retained by the Village to ensure the payment of all bills until all such bills have been paid, and to be refunded when service is discontinued if all bills have been paid. When service to the applicant is discontinued permanently, this deposit, less any amount still due to the Village for water service, shall be refunded without interest. However, where an applicant for water service is the owner of the premises to be served, no such sum shall be required.
No water shall be turned on for service in premises in which the plumbing does not comply with ordinances of this Village. However, water may be turned on for construction purposes in unfinished buildings, subject to the provisions of this chapter.
Wells used as sources of water for drinking or domestic purposes should be located and constructed so as to yield a safe water supply at all times. A well is a permanent structure, often used for many years, and should be made and kept pollution-proof. An improperly protected well may cause illness. It costs little more to construct and maintain a safe well than one subject to contamination. Safe well construction is cheap insurance. Drinking water should be not only safe but clean; therefore, the well should be protected from all kinds of contamination.

A. 
Use of groundwater as a potable water supply is prohibited at and within a five-hundred-foot radius from the perimeter of gas station property identified as 725 and 727 East Division Street. The 725 and 727 East Division Street property is approximately 400 feet long fronting First Avenue, approximately 317 feet wide fronting Division Street and approximately 490 feet long fronting the ICG Railroad and is identified as Parcels A, B and C in the legal description and plat map provided in Attachment A of Ordinance No. 03-38, in Section 2, Tier 32 North, Range 8 East in Coal City. The five-hundred-foot radius area subject to the restriction is defined on the Village street map provided in Attachment B of Ordinance No. 03-38.

B. 
The use, or attempted use as a potable water supply of groundwater at or from within a five-hundred-foot radius from each of the property boundaries of 725 and 727 East Division Street by the installation or drilling of wells or by any other method is hereby prohibited. This prohibition of wells also pertains to the Village.
C. 
Use of groundwater as a potable water supply, including for human or domestic consumption, drinking, bathing, swimming, washing dishes or preparing foods, whether accessed by the installation or drilling of wells or by any other method, is prohibited at and within the right-of-way commonly known as South Broadway Avenue within 500 feet of the property line for 135 South Broadway Avenue.

A. 
Restricted days for watering lawns and other specified uses.
(1) 
Except as provided in Subsection B of this section, water from the Village distribution system may only be used for the watering or sprinkling of gardens, lawns, shrubs or other outdoor plants, or for filling swimming pools, as follows:
(a) 
All properties with even-numbered street numbers (i.e., numbers ending in 0, 2, 4, 6, or 8) may use Village-distributed water for lawn and plant watering or pool filling on Mondays, Wednesdays and Fridays;
(b) 
All properties with odd-numbered street numbers (i.e., street numbers ending in 1, 3, 5, 7 or 9) may use Village-distributed water for lawn and plant watering or pool filling on Sundays, Tuesdays and Thursdays; and
(c) 
Water from the Village water distribution system shall not be used for the watering or sprinkling of gardens, lawns, shrubs or other outdoor plants, or the filling of swimming pools, on Saturdays.
(2) 
The restrictions set forth above shall not apply as to any other lawful use of water from the Village water distribution system such as bathing, washing, etc.
B. 
Exceptions. During the first 10 days after new sod has been placed, or lawns newly seeded or slit-seeded, property owners may use water from the Village water distribution system for the water or sprinkling of the new sod, newly seeded or slit-seeded lawns, provided they first obtain a permit as set forth below.
(1) 
Extended watering permits for new sod or newly seeded lawns. Property owners wishing permission for extended watering for new sod, newly seeded or slit-seeded lawns shall first apply to the Village for a permit to do so. The application for a permit shall be accompanied by a fee to be determined by the Board and shall state:
(a) 
The address and legal description of the property where the lawn is to be seeded.
(b) 
The name and address of the owner of said property.
(c) 
The number of square feet of new sod or lawn to be seeded.
(d) 
The date on which the sod is to be laid or seeding is to occur.
(2) 
Grant of permit. The permit for extended watering shall be granted as set forth in the application unless the Building Inspector shall find that the dates requested to water the newly sodded or seeded lawn are adverse to the health, safety and welfare of the residents of the Village due to the number of permits previously issued, and the ability of the system to supply adequate water to residents in that area for other purposes, including, but not limited to, sanitation, fire suppression, and cooking/drinking. When the Building Inspector shall find that the times requested are adverse to the health, safety and welfare of the residents of the Village, he or she shall assign to the property owner time periods for watering which are consistent with the needs of the residents of the Village. The permit shall be effective for a period of no more than 10 days.
C. 
Emergency proclamation.
(1) 
Whenever the water supply of the Village is diminished, from any cause whatsoever, to an amount which in the opinion of the Village Administrator is or is likely to become dangerous to the health and safety of the public, the Village Administrator is hereby authorized and empowered to issue a proclamation in the form of a public notice containing regulations on the use of water from the Village water distribution system. Such regulations may provide for the limited usage of water, limitations on days and hours of use for some or all purposes, and the prohibition of specified uses. Upon issuing said proclamation, the Village Administration shall make the contents thereof known to the public by news release to the local newspapers and radio media, and may also notify the citizens in any other practical manner that he or she shall devise. Further, the Village Administrator shall immediately notify all members of the Village Board of the nature of the emergency and the regulations that have been imposed.
(2) 
The emergency proclamation of the Village Administrator and the regulations imposed thereby shall remain in full force and effect until any one of the following shall occur:
(a) 
The Village Administrator determines that the emergency no longer exists and that the emergency proclamation and the regulations imposed thereby shall no longer continue in effect;
(b) 
The Village Board modifies, repeals or makes permanent the emergency proclamation and the regulations imposed thereby, by means of an ordinance passed at any regular or special meeting of the Village Board; or
(c) 
The first meeting of the Village Board occurring more than 30 days after the emergency proclamation of the Village Administrator.
D. 
Violations. Any Village employee or officer may, at the direction of the Village Administrator, notify and warn any person of the effect of said proclamation and direct said person to comply with said watering or sprinkling restrictions. If any said person, after having first been warned about said restrictions and said proclamation, shall continue to violate said restrictions of the proclamation, such person shall be deemed to be in violation of this section. Whoever violates any provisions of this chapter for which no other penalty is specified shall be subject to the penalty set forth in § 10-99 of the Code.
